The driver was being given conflicting lawful orders, watch the video. What are you supposed to do when given conflicting orders at gunpoint?

he was refusing to get out of the car.

After being asked to step out of the car a dozen times over 9 minutes and 23 seconds. These people simply get in trouble for either arguing or total lack of adherence to a command by a LEO. Maybe skin color makes you deaf or recalcitrant.

The argument is that the soldier was refusing to comply with a lawful order.

The counter-argument is that he was given simultaneous, conflicting orders (for example, “keep your hands in sight!” and “open your car door and get out!”)

If you are buckled in but at gunpoint, just how, exactly, are you supposed to do both? People have been shot for trying to follow one instruction but not the other.

Bad training on the part of the officers. ONE officer should give instructions to avoid confusion and potential bad shoots. The officers should have chosen one officer to be in control and issue instructions.

After the New Mexico shooting, I am conflicted. The guy got conflicting orders from the police, and he wasn’t a threat. The police didn’t use deadly force, but had absolutely no obvious reason to detain him.

The more dangerous it becomes for police, the more likely we are going to see this. Not sure this is about race, but it will be made so. I would have given anyone, in service to their country, a chance to slowly unbuckle the seat belt to get out.

I watched the video and it appears both cops had drawn their weapon. Why was only one fired?

They fired the dumb ass that pepper sprayed the Army guy in the eyes.

He should have been fired.

The cops were wrong, I'm pro cop, but even cops cross the line.

What this troop and apparently you failed to understand is his vehicle may have been similar to another one recently reported to have committed a crime.

"May have been"...always a good excuse.

Per LATimes...“The Los Angeles police officers who mistakenly shot at two newspaper delivery women in their truck in Torrance thinking it was the vehicle of fugitive ex-cop Christopher Dorner will be kept out of the field until an investigation into the shooting is complete, Chief Charlie Beck said.“

“The seven officers were working a protection detail Feb. 7 near the home of a high-ranking LAPD official who was a potential target for Dorner when they riddled the women's blue Toyota Tacoma truck with bullets after mistaking it for Dorner's gray Nissan truck.“

These ladies received a $4.2 million settlement from LA. l hope the Lieutenant receives the same.

Here is NOT Christopher Dorner's gray pickup truck.

I would submit that this situation is an excellent argument for why ALL police interactions should be recorded and ALL uniformed officers should be required to wear body cameras.

It doesn’t take a rocket scientist to know it requires withdrawing your hands from outside the vehicle if you are exiting the vehicle.

Perhaps it could have been handled a bit differently but anyone can be a Monday morning QB.

THe bottom line is the cops gave a lawful order to begin with and the driver opted to argue rather than comply.

Sometimes a person will refuse to immediately obey a police officer’s orders because they are hiding something. But sometimes the person is simply stunned and confused.

I watched the video a few times. That driver was stunned and confused. And he was not a threat - he had both of his hands out the window. Bottom line, as I see it: the cop wildly over-reacted, and deserves to be fired.

Live not more than 12 miles from where that incident occurred. In fact, a speeding ticket given to me by that very same Officer. And while I thank the officer for serving in law enforcement, he was a complete d*ck giving me my ticket....in the Dairy Queen parking lot right across the road from that same gas station.

I won’t fight a battle if the truth isn’t my ally but sometimes you have to fight a battle just to figure out what the truth is. Then you have to know when to swallow your pride and ally yourself to the newly discovered truth. It’s all just good dialectic.

Gimmee a break. The driver knew exactly what he was doing. He was as calm and measured as he could be and in my eyes was purposefully setting up this confrontation.

Town of Windsor has fewer than 3000 residents. Here in PA, towns many times larger have less than a dozen police on the force, and I’ve never seen one loaded up like the officer in the photo. What was he expecting to encounter in Windsor?

Except the cops are NOT working together properly and following the lawful orders of one could get him shot by the other. The cops do *not* provide instructions or give him permission to lower one hand slowly and unbuckle. One cop tells him to keep his hands up, the other tells him to get out. They are mutually exclusive and they’re implying that they’ll shoot him if he doesn’t comply.

Please tell me how this goes down if you are in the driver’s seat. Remember, if you lower a hand without permission, you will be shot. And you are buckled in, and the police are NOT doing anything but shouting “KEEP YOUR HANDS UP” and “GET OUT OF THE CAR.” Please, do tell us how you get out of the car while keeping your hands in the air.

My local departments specifically train for this sort of thing and they have one officer take the lead specifically to avoid this sort of stupid crap.

Should also point out that this went on long enough that the officers *should* have been able to realize they were given conflicting instructions, especially when the subject was telling them they were.
