. He made it clear he did not feel safe. .

His Feelings be damned.

Obey the lawful orders. Work out details and their resoning later. At night in the street with stressed out cops is NOT the place to start arguing about how good an attorney you are.

Hell, Our commanding general, told us at MIOBC and MICCC breifings that if you are stopped/confronted by cops outside Ft. Huachuca, you better pretend it is her and her SGM giving the orders and give them all due respect. If you get arrested, she'd send the SGM to get you out and work it out in court later. Cant remeber the BGs name, but she was pretty cool. SGM was a hardass though.

Was the alleged victim refusing to comply with a lawful order?

Which conflicting order should he have followed?

‘Besides the police OUGHT to tell a person why they are being stopped. That used to be the normal thing.

Too many police act like everyone not a cop must be a criminal.(Of course with the truly ridiculous enormous number of laws I seriously expect everyone IS in violation of a dozen laws they’re not even aware of).”

The police have become targets for the crazies and get no suppoort from the totally chickensh*t superiors but instead are thrown under the bus.

Why do you think so many cops are quitting?

Having had the opportunity to drive extensively throughout Euorope, one thing I’ve noticed in drivers there have much better training with respect to what to do when pulled over by police; pull over as soon as it’s safe to do so, then immediately turn off the car. Everyone understands this and everyone does this. Failing to do this is likely to result in a license suspension.

In most countries, the police will stay in their car and issue directions to the driver through the police loud-speaker. It’s very common to tell the driver to exit the vehicle and stand either by the ‘boot’ or the ‘bonnet’ then the police will exit their vehicle and make their approach.

All things considered, this is probably the better procedure. I’m not sure why law enforcement in this country doesn’t adopt a national standard. A better, universally understood SOP for traffic stops would go a long way towards ending much of the drama, IMO.

Exactly, file your complaint at a later time.

Why does his skin color or heritage matter in this situation? Why bring race into it...unless you hate fat ppl or just Mexicans in general.

Yeah.
He said he was afraid to exit and the cop said “You should be.”
Totally professional behavior on that cop’s part.

Absolutely. With the cameras we know that the driver didn’t exit the car when asked to, and that at least of the cops acted very unprofessionally.
A total screw up on both sides.

> Very Easy to survive police encounter when you are not under the influence, retarded, or hostile. <

Police encounters can be very stressful for the citizen as well as for the cop. So to be fair, I think “not scared” and “not confused” need to be added to your list.

And that’s one reason a cop’s job is difficult. A scared and confused citizen should be treated differently from a hostile one. But it’s often tough to tell the difference between the two! Nevertheless, as a trained professional, a cop has to be able to do just that.

He was given two conflicting orders. Keep his hands were the cop could see them and get out of the car. He could not obey both. I would have done the same thing I would have kept my hands where the cop could see them and hope the cop would decided shooting someone with no weapon in their hand was a bad idea and then he would clam down and get a grip on himself. From what I see in the video the second the soldier’s hands were out of site or they started to come back up the cop would have went ‘Chicago on a Saturday Night’ on him

The cop that was fired, when suspect said he was afraid to get out of the car, responded “You should be.”
How is that a professional response? He should have been more encouraging. Instead he spewed some macho BS and escalated the issue.

It doesn’t take a rocket scientist to know it requires withdrawing your hands from outside the vehicle if you are exiting the vehicle.

It also doesn't take a rocket scientist to realize that if you need to unbuckle your seat belt you will take one hand and move it out of sight of the office to nearly exactly where you would be likely to have a firearm. I can't imagine that the police officer really wants that to happen. And that is exactly why more than one driver has been shot to death by a police officer doing exactly that motion.

And also why some police officers have been shot by drivers making exactly that motion.

Smart police officers don't want the driver reaching to their right hand side unless they are very comfortable about the situation and their safety.

little off base. it is hard to follow contradictory orders and the cop should have been better trained than to see his hands in the air and expecting him to unbuckle...

i expect you are a LEO or retired who liked the power wielded in such a stop.

yes, the officer deserved to be fired.

If police quit because they don’t like being held to a high standard then that’s a good thing.

I respect police officers who know other people are citizens too.

You're correct.

I resigned the day Slick Willie was sworn in, and as his first official act declared that, the Military shall allow queers.
