Police accused of threatening, pulling gun on Black Army lieutenant during Virginia traffic stop

Virginia police pulled guns on a Black Army officer during a traffic stop and threatened to execute him in a parking lot, according to the serviceman's lawsuit and video of the encounter.

Would you care to venture as to how many stupid, BUT LAWFUL orders that this officer has given or WILL give in his military career? I will hazard more then just a few. Yet he would expect those orders to be obeyed, and might even consider recommending a court martial or an Article 15 for a subordinate who did not obey them.

I spent 26 years on active duty and the National Guard, retiring as a Master Sergeant. I was also a State Police Officer. Even the very best of officers I served under, some of whom I love and respect ENORMOUSLY, occasionally gave ill-considered and dumb-ass orders. It goes with the territory of being a fallible human being.

If you could conduct a séance with George Patton, I am sure he would express his regret over having ordered the Hammelburg raid.

My big question here is why did they exit their vehicles with their guns drawn and pointed at the driver? I’ve seen the videos and I still don’t know how this quickly escalated into the equivalent of a felon stop from the moment they exited their vehicles.

I am not saying that the police officers may not have been overbearing and utterly inappropriate as they gave conflicting orders. No matter, at the moment of confrontation, it was incumbent upon an army officer, who should understand the meaning of a lawful, if stupid order, to comply with them and sort out any wrongdoing afterward.

His behavior was just about as silly as any of the officers, PARTICULARLY when he told them that he did not have to get out of the car for a traffic violation when ordered.

You just KNOW that the Democ-RAT bastid governor Klan Man hood Northam will demagogue the hell out of this incident for to exploit racial tensions for his perceived political gain.

After seeing the sad video of the shooting of Daniel Shaver (a white man by the way, which matters to some unfortunately) by police officers giving confusing/near impossible orders, there is NO WAY as a black man I would follow the orders of one police officer telling me to ‘unbuckle my safety belt’ when there is another police officer, with gun out, telling me to ‘keep your hands up.’

No way! Next thing you’d hear is ‘he appeared to be reaching for something.’

My hands would remain very high and very visible outside the window until the cops are 100% aligned in what they are telling me.

People have been shot for less, and as a 100% law abiding citizen I would have done exactly what the Lieutenant did. Keep my hands high and outside the vehicle, and under NO circumstances be FOOLISH enough to risk my life (and it is a proper suicidal move) to go to unbuckle the belt because one officer is telling me to when the officer next to him is telling me to keep my hands up.

I will take the pepper-spray to the face any day before I take bullets to the torso. Spray to the face would ruin my day (and clear my sinuses). Bullets to the torso would ruin my family’s day. Easy decision!

As an aside - I am always VERY wary of police officers. I stay on three continents, and if I was to compare cops in Europe, Africa and the US I would say (easily) the most professional are American officers, the softest European, and in Africa one moment you can meet someone who is truly good and the next day someone else that makes you truly question standards.

However, it is only in the US and Africa that meeting a cop at night is something I consider a potentially dangerous encounter. Pulling up at a roadblock in Africa manned by five cops with Kalashnikovs and suspiciously red eyes, or being pulled over in a dark street by a cruiser in the States, are BOTH situations that require me to immediately turn on the inside lights, quickly lower the windows, call someone and put them on speaker (with the phone on the dash), and put my hands on top of the steering wheel.

In the US - a special consideration is made, which is to never have my license information in the glove box or in my pocket. I am almost always wearing a suit/jacket, and in the US they are always in my jacket!

Crazy, right?

Yes - until one watches that video of the shooting of Daniel Shaver!

Looks like the GI had a problem a) getting out of the car and b) getting prone.

who ever you are, if a cop tells you to get out of the car and get prone, do it. Have the UN summit later when the cop feels safe.

no license plate on vehicle. Failure to stop for “100 seconds” (GI’s words).

the attny for the GI said the new car paper tag was on the rear glass displayed properly. (I’m assuming on the driver side rear glass) (which, imo, if that was the reason for a stop, the cop, or his partner should have noticed as part of situational awareness, as well as noticing the caged dog in the rear that would also get teargassed, the meanies)

A great YouTube channel going over interactions between police and people. There are lots of videos of people standing up for themselves and then going on their way; there are videos of people standing up for themselves, still getting arrested, then suing the police. There are also videos of people doing stupid things and getting arrested.

I agree with you for the most part. There are some people who unnecessarily get into a back-and-forth with police officers. Waste of time for everyone involved.

My one question though is this - aren’t the conflicting orders potentially life threatening? Having two officers with guns drawn, one saying ‘hands up’ and the other telling you to unbuckle your seat belt, which for most vehicles is down by your side - near where you’d have a firearm - be something that could potentially be dangerous?

After watching the video of the shooting of Daniel Shaver, there is no way I would personally reach down to release my safety belt buckle when I have a Glock to my face from someone clearly telling me to keep my hands up.

Once all police officers have ONE message then I will follow it, but it would be impossible for me to follow conflicting orders from people holding firearms. I would take the safest/most conservative action - in that particular case keeping my hands up and outside the vehicle - and stay there until both cops are saying the same thing.

Well, it sure does appear that my strategy of just putting my hands up (and staying that way until the cops are sure whether they want someone to do X or Y) is not even 100% effective. Crazy video.

The one though that really shocked me was the Daniel Shaver video. That man literally had no chance of survival the moment the cops showed up. I tried to recreate the situation on the floor at the time, and it’s literally an impossible set of actions to follow (unless someone can levitate).

Getting out the car required unbuckling the seat belt. Unbuckling the seat belt required reaching to his side. That could appear as reaching for a weapon, especially when the second cop is screaming for him to keep his hands up.

It’s a bit difficult to follow two orders that are polar opposites to each other. Especially when both are being given by men with guns pointed at you.

Yup. Every interior light on, windows rolled down, ignition off, keys and wallet/DL/registration on the dash, hands in plain sight on the steering wheel before officer Friendly gets to the door.

I screwed up once, forgot to roll down the windows before putting the keys on the dash.

Officer Friendly at the passenger door and I hit the button to lower the window.

My exasperated expression as I slowly turned the ignition to the auxiliary position was a source of vast amusement to him.

Thank God...

What do you do when there are two cops with drawn guns and one is threatening to shoot you if you move your hands out of his sight to unbuckle the seat belt and open the door, and the other is threatening to shoot you if you don't get out of the car and hit the deck "RIGHT FOOKING NOW!"?

Serious question.

What would you do?

You’re leaving out some details. He said he was going to pull into a safe area off the highway and he did so while driving slowly. Are you suggesting this was a pursuit?

Btw, more cops are killed in vehicle collisions and getting hit by vehicles than are killed by gunfire.
