The bank can do what it pleases.
The cop overreacted.....................
Really? A private business can set their own rules?
What if that private business WANTED to allow smoking on their premises?
To my knowledge almost all localities restrict smoking in private businesses.
Wut?
Private business owners retain rights, including the right to refuse service based on rules they establish so long as those rules don’t violate federal or state law.
If a private business doesn’t want to serve you and instead wants you to leave and you don’t leave, you’re trespassing. If you trespass, you’re subject to arrest by the jurisdictional police authority.
That’s EXACTLY what happened here. The cop showed up, told her to leave and she didn’t. So, he arrested her EXACTLY like it should happen.
Protecting the private property rights of the business owner isn’t tyranny. Stop being so melodramatic.
“A private business can set their own rules?”
This is an interesting video on that subject:

Well said! I would add to this, a slight revision to a great quote from Iron Mike Tyson (heavyweight boxing legend, for those too young to remember/know):
"Face masks made you all way too comfortable with disrespecting people and not getting punched in the face for it."
Waiting for the Karens to respond with, "but you not wearing a face mask endangers me! It violates MY rights! You don't have the right to infect me with a deadly disease!"
But Karens are too stupid to understand, much less recognize, the hypocrisy and logical inconsistency of what they say, so who cares?
This could be landmark case. Sue the sh!t out of BOA and the cops! Put them both on the stand and point blank ask them if masks prevent COVID? If they say yes, show them a box of masks and read the disclaimer where it says it doesn’t. If they say it doesn’t, they just lost the case, and it was assault.
Sorry, but a bank is an exclusive premises to an account holder- they have a license that cannot be revoked simply because someone says so. They hold personal property in trust and cannot prohibit one from securing or removing their property. She will win in civil court against not only the police who should have enforced the termination of the mask ban against the bank, but also against the bank.
The private property argument goes only so far and cannot be used to deprive someone of license or property unless that act is enforceable by law.
Its not the same as “no pets” “no shirt no shoes no service”. Which have roots in public law.
Its more like “whites only” or “BLM only”.
Wait and see.
Nope, it's not clearcut at all. It's a bank, for one thing. The bank and the account holder have a relationship which is not subject to the arbitrary whim of the bank, despite efforts to frame it so. Furthermore they are a public corporation, not a private retail establishment, so they can't hide behind private property as a perfect shield against any misfeasance...
Trying to reframe it as trespass in a private business is what the bank (and the police too) would like, but it doesn't make it right. They have her money (her private property, and she is a private party too!), they need to figure out a way to accommodate her that is not capricious and arbitrary...the mask rule in Texas just became arbitrary. The police know this.
Bank of America is insane.
= = =
I had a check from a friend, written on his account at a local BofA.
I stepped up to the BofA counter to cash it. I did not have an account with them.
They wanted $7 to cash his check.
I just turned around and walked out.
(Cashed it at my bank later, no fee, no problem.)
I’ve stopped patronizing our local Ace Hardware for the very same reason. They’ve posted very aggressive Karens just inside the entrance demanding all who enter don a mask. And as a new homeowner, I was one of their best customers!
(Cashed it at my bank later, no fee, no problem.)
I agree with you in the frustration but there may be a legit reason. We all pay a price for others doing crime.
And Yahoo is calling HER a Karen for NOT wearing a mask. See how they (News media) are changing the narrative. I find this as disturbing as the arrest.
Sounds like them. There’s a BoA close to where I live. There should be a warning label on the place.
I’m mean as a rattlesnake and tough as a titan’s toenail but even I know you don’t argue with armed men wearing a badge.
As for a shitoutfit like Bank of America don’t do business with their nasty asses - but do ask to use their restroom and if they say no call the Health Department on them.
If they say yes (health laws say public venues have to have accessable toilets) then pinch a big ole loaf but miss the bowl.
Then yowl about how filthy the restroom is for the benefit of the customers in the lobby as you leave.
This is what happens when you let illegal immigrants run the country.
Well, they were willing to cash his check for $7.
It was for over $500 as I recall. $7 wouldn’t have covered that.
Many years ago I had a BofA account. I quit when they started charging me to keep my money. Went to get my money out.
First clerk said, “But you have been with us for so long . . .”
Second clerk said, “Oh.”
You're missing the larger point here. This wasn't a thing until last year. Prior to COVID you could wear practically anything you wanted in a bank or any other business and get service. When was the last time you saw anybody actually enforcing a dress code by calling the cops? And make no mistake...this is a DRESS CODE by the bank. It's not a law because the law says she doesn't have to wear a mask.
It's a DRESS CODE then. When was the last time you saw the cops come out to a business to enforce a dress code? When was the last time a business called the police to enforce a dress code?
This is insane.
That's precisely why we are now in the process of closing the credit card accounts we've had with them for 26 years.
Goodbye, BOA!
I think some people have found their bully niche and they really like it.
