65 Year Old Woman Tackled, Arrested For Refusing To Mask A Day After Abbott Lifted Mandate

The mask mandate was lifted statewide on March 10, but the very next day a 65-year old woman was tackled to the ground by police after being told by a Galveston Bank of America branch to mask up.

She later recounted in an interview with FOX Houston that she was there to close her account, and that she couldn’t enter the drive-thru. “Ma’am you have to leave…,” the bank staff told her upon entering. “I just want to close my account, I’m gonna get my money and then I’ll leave. I can’t use the drive-thru, I’m pulling the rig.”

Which will be completely useless.

The cop was right. It’s a private business. They have the right to establish the rules of entry into their business. If you don’t want to wear shoes or a shirt or a mask, they can refuse entry. If you don’t leave, they can call the police who will then arrest you for criminal trespass.

I think masks are idiotic. But, I also believe in the rights of private property owners. If you don’t want to wear a mask, then don’t enter the private business. If you don’t want to get arrested, then leave when the cop tells you to leave. It’s that simple. She wasn’t arrested for not wearing a mask. She was arrested for not leaving when instructed to leave. That’s what’s supposed to happen on private property.

The Austin Gestapo in action. This is our country folks. If this can happen in Texas it will happen in a city near you. Looks like the Gestapo enforces rules not laws. I assume the Mayor came up with this rule/edict. He should be arrested by the Gestapo also.

Good post yours. One thing conservatives value is property rights. This was a “no shoes, no service” type of thing.

But as you noted, the level of force the cop applied - that’s a separate issue.

state mandate may have been lifted, but the bank can set their own rules - she can choose to do business with them or not.

She is a fault in this case.

(On another thread) I’ve tried throughout the ControllaVirus sham to patronize smaller local businesses. I recounted how I stopped into a store that I have done business for 40+ years. The employees wear face diapers and they have plastic shields at each counter so my weariing a diaper makes no logical sense. Also, I have (during the sham) visited their establishment bare-faced.

But this time a zealous employee badgered me about complying. In response I literally dropped an armful of items and left, quietly informing them that I would not be back.

I went home and ordered the same items from Amazon. Amazon wins, they lose.

She could have got in line with the vehicles going thru the drive
thru and walked up to the drive thru window and not went inside.

She probably had a masked inside her vehicle and didn’t think to
put it on when she went inside. I done that some times and have to
turn around and go back and get my mask.

Oops, fail. The police don't have the right to exercise police power, they are not entitled to do their duty. What they have is an authority. The authority is derived from the delegation of powers, not the sovereign right of the government. We're citizens, not subjects.

When a police officer says they have a right to act, they are exceeding their jurisdiction. When you say it about the police, you are submitting to a tyranny.

They have the right to establish the rules of entry into their business.

They also have the responsibility to accommodate the public. Mandatory masking is over, so there's no basis for the rule, it's capricious and arbitrary, now equivalent to a rule that she must wear a tie or a burka to be allowed entrance.

Escalating to trespass over an arbitrary policy to avoid dealing with a customer who wants to terminate the relationship and reclaim their property also could be construed as contrary to the fiduciary duty of the bank, as they are violating their duty of care...could be construed as a false police report by a sufficiently enabled attorney.

It used to be that wearing a mask in a bank would get you arrested. Now it is required. It’s a crazy world.

Mandatory shirt and shoe wearing is also over (it actually never started). Do retail businesses not have a right to require those for entry as well?

If you own a retail business, you're allowed to establish those rules. There is not 'arbitrary' test.
