Limited-government federalism is what most of the founders envisioned as a permanent ideology guiding this nation through history. They wanted power divided not only between branches of government but also between the jurisdictions. Thomas Jefferson wanted a government in which states were supreme. Alexander Hamilton wanted states and the national government to share powers. What we have today would be opposed by both as Washington DC holds supremacy against the Constitution itself.
States are pushing back. We started seeing this happening under Barack Obama as conservative states went after the federal government over his massive overreach. Then, Democrats learned to embrace federalism under President Trump, particularly as it pertained to sanctuary status and immigration policies. Now, Republican states are pushing back against the Biden regime, which in its early days has already demonstrated a willingness to overstep their boundaries more so than his two predecessors.
In the latest episode of Conservative Playbook, we dissected a few of the stories popping up across the nation that demonstrate a clear embrace of the tenets of limited-government federalism.
According to a Red State article titled New Bills in North and South Dakota Would Allow the State to Ignore Executive Orders From Biden:
House Bill 1164, submitted by Republican State Rep. Tom Kading, reads:
The legislative management may review any executive order issued by the president of the United States which has not been affirmed by a vote of the Congress of the United States and signed into law as prescribed by the Constitution of the United States and recommend to the attorney general and the governor that the executive order be further reviewed. Upon recommendation from the legislative management, the attorney general shall review the executive order to determine the constitutionality of the order and whether the state should seek an exemption from the application of the order or seek to have the order declared to be an unconstitutional exercise of legislative authority by the president.
In other words, if Biden issues an executive order, the state’s attorney general may review the order to determine if it complies with the Constitution. From there, the state will determine if they should seek exemption from the order or challenge the order on constitutional grounds.
Daniel Horowitz over at The Blaze writes Missouri county authorizes arrest of feds who violate Second Amendment:
What is our recourse when our own government criminalizes our most basic rights while it allows Black Lives Matter and Antifa to rampage through our streets with impunity? Is there no Plan B when the federal or state governments treat all conservatives like terrorists, business owners like pariahs, and those who yearn to breathe unmasked air like murderers? Well, one Missouri county is demonstrating the importance of sheriffs and county officials returning to self-government and interposing between the governmental usurpers and the most sacred rights of the people.
On Feb. 3, the Newton County, Missouri, Commission passed a bill that will not only block federal enforcement of unconstitutional gun policies, but criminalize their implantation thereof within the jurisdiction of the county. The “Second Amendment Preservation Act of Newton County Missouri” declares that “all federal acts, laws, orders, rules, and regulations passed by the federal government and specifically any Presidential Administration whether past, present, or future, which infringe on the people’s right to keep and bear arms as guaranteed by the Second Amendment of the United States Constitution and Article I, Section 23 of the Missouri Constitution shall be invalid in the county.”
Across the nation, states are rediscovering the protections the Constitution gives them against an oppressive federal government. They are the strongest line of defense against draconian edicts from the Biden regime.
All for show. Will not happen.
Prelude to the coming civil war?
Yep, all talk for sound bites and YouTube clips for fundraising.
All for show. Will not happen.
The battle is fought on many fronts, find your post.
Man the bulwarks !
The commies are at the gate.
Individuals must do what the limp-wristed politicians will not.
States should apply this exact same “precedent” to regain their sovereignty and ability to manage their own affairs according to the unique needs of each state.
If they can do it, so can we.
That’s the only way to get out of this...the states have got to fight the Dem rule by diktat and the blatant unconstitutionality of these “orders,” which interfere with the prerogatives of the states.
I think it’s going to happen. There is pushback on the Keystone cancellation, and I think you’ll see more on other “orders” as they become known. I’m hoping there will be state pushback on this stupid masking on public transit order, which is way beyond Biden’s competence and interferes with interstate commerce.
Of course Feds are threatening top withhold funds from Texas, but I am willing to make my payments to the State of Texas rather than DC.
Forgot to say that the Texas sanctuary is based on CA, NY, OR, CO etc sanctuary for illegals that was NOT prevented by DC.
You can help make it happen at your local and State level.
Good point.
You can help make it happen at your local and State level.
Amen.
Better to be proactive and involved, than to just sit on the sidelines and whine.
It's only a show if you just sit there and watch.
With all due respect to state Rep. Tom Kading, please consider the following.
The basic litmus test that local and state governments need to wake up to and apply to every action, law and domestic spending by the federal government is this. If any action, particularly federal domestic spending, is not reasonably related to the US Mail Service then the action is probably unconstitutional and take the feds to court to put a stop to the fed's action.
"Article I, Section 8, Clause 7: To establish Post Offices and post Roads;"
”From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added].” —United States v. Butler, 1936.
Next, patriots have got to start following THEIR money in the following way. Patriots need to identify deferred maintenance in their communities, building new K-12 buildings for example.
The key to paying for new K-12 buildings is this. Patriots need to pressure local and state government leaders that if they don’t put a stop to unconstitutional federal taxes, taxes that corrupt Congress cannot justify under the very limited powers that the states have expressly constitutionally given to the feds, taxes that are rightfully at the disposal of local communities to pay for new school buildings, then patriots will keep recalling and replacing local and state leaders until they find somebody who will stand up to the unconstitutionally big federal for them.
"Congress is not empowered to tax for those purposes which are within the exclusive province of the States." —Justice John Marshall, Gibbons v. Ogden, 1824.
”[…] the care of the property, the liberty, and the life of the citizen, under the solemn sanction of an oath imposed by your Federal Constitution, is in the States, and not in the Federal Government [emphases added].” —Rep. John Bingham, Congressional Globe, 1866. (See about middle of 3rd column.)
"It is one of the happy incidents of the federal system that a single courageous State may, if its citizens choose [emphasis added], serve as a laboratory; and try novel social and economic experiments without risk to the rest of the country.” —Justice Brandeis, Laboratories of democracy.
In fact, noting that the product of a constitutional convention is not a new amendment to the Constitution as many patriots seem to think, us despicables need to demand that local and state government leaders prove their worth by calling a constitutional convention to repeal the 16th and ill-conceived 17th Amendments ASAP.
Community schools
Repaired roads, new roads
More funding for police and fire departments
Scholarships for students attending intrastate schools etc.
As a side note to recall elections mentioned above, patriots first need to work with state lawmakers to amend respective state constitutions to require people planning to run for state and local offices to escrow a refundable "recall deposit" before becoming a candidate for any office. The deposit will fully pay in advance for their possible recall elections if they are elected, amounts determined by law.
I want to add I can guarantee you it's not just for show in Texas. Our Governor and AG are fully supporting and pushing for several bills that nullify new federal gun law and they will have the unwavering support of the voters. This is the first step moving to nullification of ALL federal gun law.
If you or anyone else is not sure what you can do. You can help even if you don't live in Texas. You can simply make a small donation to the Texas State Rifle Association. They are a very effective lobby here in the state and even small donations help. It's a simple step and it's effective. Others here may have information for other states.
We need to focus on conservative run states. Once one state takes the lead others will follow. This is the way our republic was supposed to work in the first place.
Agree
Ending the Filibuster
Packing the courts
Nationalizing election law that make elections less secure
Texas is taking steps to become a sanctuary state over the second amendment. Austin is working to pass legislature that will prevent local, county, state LEOs from carrying out unconstitutional acts on behalf of the Feds. Even without the piece of paper from Austin many departments have said they will not work with Feds to enforce illegal orders.
Of course Feds are threatening top withhold funds from Texas, but I am willing to make my payments to the State of Texas rather than DC.
