I tend to agree, but the charge is supposed to be incitement, isn't it?

That has nothing to do with an election so .... maybe no fraud IS a good idea

I just hate the democrats for muddying our beautiful nation .... and President.

Are they flip flopping to keep the Dems off guard? Or to keep us stressing?

The whole purpose for the rally was the stolen election. Otherwise it will just look like the President was on an ego trip to cause trouble.

Impeachment should not even be discussed unless they want to admit he is the REAL president.

Every rational person knows that to be true and so naturally, the democrats dont.

Exactly right. they claim he fired up people to riot by claiming it was false. Then , he has a right to prove it isn't false. Simply placing doubt as to true or false is good enough, it crushes their baseless assertion that it was false . Now I know why they are going forward with the impeachment-they are terrified that something will come out which will show he won. They have to close and seal that door.

The issue is that election fraud is in the article of impeachment. A first response would be to say that it is improper to include a charge in the article of impeachment and then deny the President the right to put up a defense against the charge.

From the article of impeachment:

2 ...In the months preceding the Joint Ses
3 sion, President Trump repeatedly issued false statements
4 asserting that the Presidential election results were the
5 product of widespread fraud and should not be accepted
6 by the American people or certified by State or Federal
7 officials. Shortly before the Joint Session commenced,
8 President Trump, addressed a crowd at the Ellipse in
9 Washington, DC. There, he reiterated false claims that
10 ‘‘we won this election, and we won it by a landslide’’.

The predicate for Trump's alleged crime is that he repeatedly made "false statements" that said that the election was fraudulently won and that's how he "incited" the crowd at the rally.

A natural defense would be that the crowd didn't need "incitement" on this issue because there was plenty of public information already out there that the people were well aware of. He could then submit as evidence the information that the people had access to.

I would say that he doesn't necessarily want to spend the time trying to prove that the election was fraudulently won, but only that reporting of the evidence of election fraud presented at hearings held by several state legislatures was widely available to people who attended the rally, and therefore the President did not incite the crowd "with false statements."

These were statements made under oath at several state legislature hearings, the President should argue.

I think he needs to start his own media station, where he can show what he has. But right now, he needs to stay safe. He doesn't owe us, at least me, anything at this point, as this is just another sham political hack job.

If they try to nail him after the sham impeachment, when he does go forth with his proof of a stolen election, he can say he is doing nothing more than Hillary did when she railed on for 4 years how the election was stolen from her.

Just listening to a JR Nyquist interview. He said we are pretty much mirroring the Spanish Revolution. The right had gotten to a place where they simply weren't allowed to be in power, were blamed for violence when it was the left committing all the violence, etc.

Where is Franco? I am ready.

The Senate Can Not Put A Private Citizen On Trial.

 

If they begin this charade in the Senate, it will be transparently clear proof our Constitution is dead.

Any "trial" of Trump in the Senate is unlawful, unconstitutional. Not that that will stop any of it.

Trump is a private citizen now. The Senate has zero authority to put a private citizen on trial.

They will read the "impeachment" from the House:

Article of impeachment exhibited by the House of Representatives of the United States of America in the name of itself and of the people of the United States of America, against Donald John Trump, President of the United States of America, in maintenance and support of its impeachment against him for high crimes and misdemeanors.

ARTICLE I: INCITEMENT OF INSURRECTION

The Constitution provides that the House of Representatives “shall have the sole Power of Impeachment” and that the President “shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors”. Further, section 3 of the 14th Amendment to the Constitution prohibits any person who has “engaged in insurrection or rebellion against” the United States from “hold[ing] any office … under the United States”. In his conduct while President of the United States—and in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed—Donald John Trump engaged in high Crimes and Misdemeanors by inciting violence against the Government of the United States, in that:

On January 6, 2021, pursuant to the 12th Amendment to the Constitution of the United States, the Vice President of the United States, the House of Representatives, and the Senate met at the United States Capitol for a Joint Session of Congress to count the votes of the Electoral College. In the months preceding the Joint Session, President Trump repeatedly issued false statements asserting that the Presidential election results were the product of widespread fraud and should not be accepted by the American people or certified by State or Federal officials. Shortly before the Joint Session commenced, President Trump, addressed a crowd at the Ellipse in Washington, DC. There, he reiterated false claims that “we won this election, and we won it by a landslide”. He also willfully made statements that, in context, encouraged—and foreseeably resulted in—lawless action at the Capitol, such as: “if you don’t fight like hell you’re not going to have a country anymore”. Thus incited by President Trump, members of the crowd he had addressed, in an attempt to, among other objectives, interfere with the Joint Session’s solemn constitutional duty to certify the results of the 2020 Presidential election, unlawfully breached and vandalized the Capitol, injured and killed law enforcement personnel, menaced Members of Congress, the Vice President, and Congressional personnel, and engaged in other violent, deadly, destructive, and seditious acts.

President Trump’s conduct on January 6, 2021, followed his prior efforts to subvert and obstruct the certification of the results of the 2020 Presidential election. Those prior efforts included a phone call on January 2, 2021, during which President Trump urged the secretary of state of Georgia, Brad Raffensperger, to “find” enough votes to overturn the Georgia Presidential election results and threatened Secretary Raffensperger if he failed to do so.

In all this, President Trump gravely endangered the security of the United States and its institutions of Government. He threatened the integrity of the democratic system, interfered with the peaceful transition of power, and imperiled a coequal branch of Government. He thereby betrayed his trust as President, to the manifest injury of the people of the United States.

Wherefore, Donald John Trump, by such conduct, has demonstrated that he will remain a threat to national security, democracy, and the Constitution if allowed to remain in office, and has acted in a manner grossly incompatible with self-governance and the rule of law. Donald John Trump thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States.

Attest:

Since Trump is now a private citizen, this "impeachment" of "Donald John Trump, President of the United States" is now MOOT.

Not to mention, if chief justice Roberts really does NOT show up, the trial should be shut down immediately as the Constitution REQUIRES he preside over the trial.

This is precisely why chief justice Roberts will not being overseeing this crystal clear mockery of the Constitution. Even he....can not go along with this unconstitutionality.

Article I, Section 3, Clause 6:

The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

Our friend Steve Bannon will be very disappointed. As will I.

I had anticipated some Dem shenanigans to avoid the election fraud issue but I didn’t expect the trick to be executed by the Trump lawyers.

As to winning the Senate trial and having plenty of ammunition - well duh, Trump the Traitor is just a story made up by Pelosi and Schumer. I could successfully defend Trump.

To me it looks like a missed opportunity to officially introduce proof of election fraud. I guess Trump has been talked out of it. Sad to say.
