An attorney for former President Donald Trump said he won’t bring up claims about election fraud while defending the former president during the upcoming impeachment trial.
“There are plenty of questions about how the election was conducted throughout the country, but that’s for a different forum, and I don’t believe that’s important to litigate in the Senate trial because you don’t need it,” attorney Bruce Castor told KYW Newsradio Philadelphia. “President Trump has plenty to win with what he has.”
Castor also pushed back against reports that Trump parted ways with his initial legal team about whether they would advance his claims about election fraud.
“I don’t know where people got that notion that was some sort of litmus test to get to defend the president, because as you saw from the document I filed, which had to be approved by the president personally, there isn’t anything in there about the election being stolen,” Castor said.
Castor and fellow Trump lawyer David Schoen filed a response to House Democratic impeachment managers on Feb. 2, arguing that the impeachment trial is unconstitutional because Trump doesn’t currently hold office. They also argued that Trump has a First Amendment right to express his views about the accuracy of the election results.
Democrats argued that Trump’s speech wasn’t constitutionally protected and said it incited an insurrection at the Capitol on Jan. 6.
“Just because somebody gave a speech and people got excited, it doesn’t mean it’s the speechmaker’s fault—it’s the people who got excited and did what they know is wrong,” Castor said in pushing back against Democrats, referring to Trump’s remarks to a crowd on Jan. 6.

Every rational person knows that to be true and so naturally, the democrats dont.
I think they’re afraid of him whether he runs again or not.
They hate his popularity and influence and what sane historians of the future will write about him. They hate the influence he will continue to have in his future endeavors.
And they want to ‘deprogram’ US. They think that tarring our President will help them in that cause.
I wish he would do that. He is now *MISTER Donskd Trump and he can send in his lawyers.

The one word I wouldn’t associate with Trump is weak but the guys people skills are terrible he trusts people who literally slither when they walk he didn’t have to sit down for 9 hours with Bob Woodward but he did, he didn’t have to fight with the press during the Covid briefings but he did, he didn’t have to give an interview to the most hostile press while the other guy hid but he did, he chose these paths he’s not week but he has blind spot for trying to get affection from people who hate him and ultimately it did him in

His attorneys are thinking just stick with it being unconstitutional and you’ll skate but just realize there’s enough senators in the GOP who hate you that it would give them a free pass to vote to convict you and then you can’t run again

This is a sham trial. The odds of him being allowed to present, or argue, election fraud are zero.
I don’t think he should even give them the time of day.
As an aside, say he presents his arguments. Then what?

The predicate for Trump's alleged crime is that he repeatedly made "false statements" that said that the election was fraudulently won and that's how he "incited" the crowd at the rally.
A natural defense would be that the crowd didn't need "incitement" on this issue because there was plenty of public information already out there that the people were well aware of. He could then submit as evidence the information that the people had access to.
I would say that he doesn't necessarily want to spend the time trying to prove that the election was fraudulently won, but only that reporting of the evidence of election fraud presented at hearings held by several state legislatures was widely available to people who attended the rally, and therefore the President did not incite the crowd "with false statements."
These were statements made under oath at several state legislature hearings, the President should argue.

Why? To set an example for anyone outside the corrupt system that thinks they might try to do the same as Trump. They must ruin Trump, his allies, friends, associates, family, and wealth. Examples must be made.

No fraud investigation at the senate hearing and no conviction.
If they try to nail him after the sham impeachment, when he does go forth with his proof of a stolen election, he can say he is doing nothing more than Hillary did when she railed on for 4 years how the election was stolen from her.
What a wasted opportunity. Why not just mail it in and piss on all of his voters.

What kind of fight? You honestly believe the stolen election, as vast and complicated as it is, can be resolved in a kangaroo court, with McConnell, drooling at the idea of stabbing Trump in the back, in charge of the Republicans.
For a successful fight over the election, it has to be done in the states where it occurred, not before 100 prima donnas with more than half of them corrupt.
