Trump Impeachment Lawyer: ‘Stolen’ Election Claims Won’t Be Brought Up During Trial

An attorney for former President Donald Trump said he won’t bring up claims about election fraud while defending the former president during the upcoming impeachment trial.

“There are plenty of questions about how the election was conducted throughout the country, but that’s for a different forum, and I don’t believe that’s important to litigate in the Senate trial because you don’t need it,” attorney Bruce Castor told KYW Newsradio Philadelphia. “President Trump has plenty to win with what he has.”

Castor also pushed back against reports that Trump parted ways with his initial legal team about whether they would advance his claims about election fraud.

“I don’t know where people got that notion that was some sort of litmus test to get to defend the president, because as you saw from the document I filed, which had to be approved by the president personally, there isn’t anything in there about the election being stolen,” Castor said.

Castor and fellow Trump lawyer David Schoen filed a response to House Democratic impeachment managers on Feb. 2, arguing that the impeachment trial is unconstitutional because Trump doesn’t currently hold office. They also argued that Trump has a First Amendment right to express his views about the accuracy of the election results.

Democrats argued that Trump’s speech wasn’t constitutionally protected and said it incited an insurrection at the Capitol on Jan. 6.

“Just because somebody gave a speech and people got excited, it doesn’t mean it’s the speechmaker’s fault—it’s the people who got excited and did what they know is wrong,” Castor said in pushing back against Democrats, referring to Trump’s remarks to a crowd on Jan. 6.

If true, I find it very disappointing and discouraging. There was in your face fraud and nobody is acknowledging it. The fact that Trump is rolling over now is the first time I am directly disappointed in Trump. I don’t see how he could be reelected after this. It appears he has buckled under the pressure.

Trump allowed the election to be stolen. He had all of the power, and support that he needed to head it off at the pass. To stop it before it happened. Not wait until after it happened.


Trump had all the power? LOL. That’s funny. Maybe the silliest thing I’ve ever red here. Trump had basically no power thanks to the bipartisan coup. Democrats with top cover from the GOP fully controlled all the important bits of the executive branch. DOJ, DOD, etc.

Agreed. This trial will not change anyone mind. detailed audit of votes will and they're still working on that (Arizona legislator full audit. The other audit done in the same state is a waste of time)

IMHO, I think Trump should just tell them all to go to H-E-double toothpicks, he’s not going to DC for a trial which is clearly a dog and pony show and nothing more. He’s a private citizen now. The HELL with what they want.

Why is he even giving this one bit of attention? It’s completely unconstitutional, it’s not a criminal trial, it’s a Nancy Pelosi clown show. The only response Trump should give is:

“Nancy Pelosi for the 2nd time in 3 years committed a criminal act when she violated the Stock act of 2012 by trading on insider information this time for Tesla stock. When is Nancy resigning or will she be impeached?”

Considering that the main line of defense is that the whole trial is unconstitutional to begin with, and considering the claims of election fraud have nothing to do with the charge that Trump incited insurrection, then it’s not surprising that they’re dropping it.

I read an opinion that since this Senate Impeachment trial violates Trump's rights as a Private Citizen, he can bring his case to the SCOTUS.

Roberts would refuse to take the case for lack of standing. (sorry, just feeling sarcastic)

GOOD!!!! Destroy the bogus “impeachment trial” because of its gross unconstitutionality! Then present incontrovertible proof the the election was stolen in later forums!

Moreover, nearly ALL of biden’s dictatorial “executive orders” should face lawsuits by aggrieved parties! That begins with the order to shut down the Keystone Pipeline!!!!

And since the Constitution does not allow for the impeachment of a president who left office, the very fact that Trump is being impeached is an admission that Trump is still President.

If I were the Presidents lawyers I would be asking the Senate for an order to tell Biden to clear out of the White House....STAT!

And if the Senate issue an guilty resolution , that means that President Trump is indeed President, one who is impeached , and Mile Pence is the President.

My assumption: McConnell told Trump 'bring up election fraud and we will convict you. Shut up about them and this goes away'.

The GOP is all in on protecting the fraud machine. They are in on it.

I tend to agree, but the charge is supposed to be incitement, isn't it?

That has nothing to do with an election so .... maybe no fraud IS a good idea

I just hate the democrats for muddying our beautiful nation .... and President.

Since it IS a KANGAROO Court and an unconstitutional procedure (Bill of Attainder) there’s no reason at all to think that the actors in control would allow for any defense

The outcome is that he will be found guilty. It is a kangaroo Court. The truth does not matter. The verdict has already been decided. He should get his butt out of the Country. Poland would take him. Hungry would take him. Before the Communists in Power are through with us, we will wish we had fought when we had the chance. On second thought, I take that back. There is no fight left in us. I thought we would fight other than surrender. I was wrong.

Are they flip flopping to keep the Dems off guard? Or to keep us stressing?

The whole purpose for the rally was the stolen election. Otherwise it will just look like the President was on an ego trip to cause trouble.

Impeachment should not even be discussed unless they want to admit he is the REAL president.
