As thousands of Trump supporters prepare to descend upon the Capitol this coming week amid a presidential election they are contesting, there is a mass of confusion and conflicting information about what happens next.
You may have heard that a growing list of Republican members of the House and Senate have pledged to object to the electoral count of some states during Wednesday's joint session of Congress.
Most analysts have said such objections, in practical terms, amount to nothing because while they can trigger debates lasting up to two hours, it would take a majority in both the House and Senate to reject the state results naming Joe Biden the next president of the United States.
There are other less discussed and, some insist, less likely scenarios. Some of them are examined in a legal analysis by John Yoo and Robert Delahunty. Published in October, about two weeks before the presidential election, it plays out multiple scenarios including under circumstances like the ones we face today. It is titled "What Happens if No One Wins? The Constitution provides for election crises—and its provisions favor Trump."
Here are some applicable excerpts from the analysis.
"Suppose states send electoral votes that—even if certified by the governor—remain under question, whether because of fraud in the vote, inability to count the ballots accurately under neutral rules, or a dispute between branches of a state government...
...Vice President Pence would decide between competing slates of electors...
...If the electoral count remains uncertain enough to deprive either Trump or Biden of a majority in the Electoral College, then the 12th Amendment orders that “the House of Representatives shall choose immediately, by ballot, the President...
...If today’s House chose the president, voting by state delegations, Trump would win handily."

I agree with your take.
Not a bad idea.
As long as they have their ducks in row, I’m all for it.
I do not want them making charges and then finding out realty
didn’t back up what they charged.
Hope all is well with you.
I agree with that.
My only pass/fail on this, is that they have hard evidence in
each state Pence needs to pull the alternate electors from.
If we’re on solid ground, then there’s no question Pence
should do it.
As for courts, what courts? We have some folks in black
clown suits, not referencing the Constitution at all these
days.
I agree with that.

The Democrats were outsmarted by Stalin.
They forgot one word....
It’s the FINAL person that counts the votes that matters.
“It advises that he would be the one to judge the validity and legality of any competing slate of electors.”
How many competing slates of Electors are there currently?
If Private Snuffy Smith in his foxhole can jump up and charge when ordered, can we ask and expect less of his leaders?
Snuffy is protecting his comrades, Mike Pence, a public s servant, is protecting his fellow Americans, it is of a muchness, the same. Private or VP, the times call forth the man, the man must answer.
another optimistic thought—
how does one conduct business most efficiently during a rainstorm?
- by staying out of the rain as much as possible.
with republicans, this means waiting until the last moment to announce a decision that could be regarded by the MSM as unfavorable.
we have seen such behavior with republicans most recently in the confirmation of ACB to the USSC.
And another slate from the GOP legislators favoring Trump.
The ones favoring Biden in these contested states are the ones the analysis says Pence can toss if there are questions of fraud or irregularities in the election.
Give me a break...
Seems most legal analysts on Trumps team were D- in their first year of law school or just political hacks .
These people taking advantage of Trump supporters bless their hearts but don’t give them a penny..
I think with hundreds of Republicans strenuously objecting to the Biden electors for the contested states, and demanding further investigation, there will not be the perception that VP Pence is somehow going it alone.
With that kind of wind at his back, it will already be a foregone conclusion that this unprecedented mess cannot and should not be settled January 6th.
I am imagining someone like Ted Cruz or Josh Hawley, making one critical point in the televised debate and not even the Democrats will have an answer:
Namely, that in each of the six Democrat run cities where fraud is alleged to have occurred, Team Trump has asked to examine evidence, and cross examine witnesses, and has been denied access every step of the way.
That one fact will hit the American people like a ton of bricks.
How can the Democrats answer that?
How can the Secretaries of State, who certified electors for their respective states, defend those certifications when access to critical evidence and key witnesses has been denied to lawyers for the plaintiff?
I think there is no way this gets settled January 6th over the strenuous objections of several hundred Republican members.
If it takes only one Senator and one Representative to trigger a floor debate - what does several hundred members trigger? I’d say whatever it triggers - it certainly won’t be wrapped up in a single day or even a week.
Thanks for the thoughts. Sounds reasonable.
These days you can take reasonable and toss it out the
window. Not to insult you, but I’m sure you know what
I mean.
I hope you are correct. You “should be”, but who knows?
That is good Steve.
I liked your thought about hundreds of Republicans demanding
this be addressed.
That’s about our only hope.
Mitch has sure shown his true colors now hasn’t he.
You either support the fraud or you are scared of the left.
Which is it?
This is two hours PER OBJECTION!
“Mitch has sure shown his true colors now hasn’t he.“
I’m getting a weird vibe from Mitch’s comment saying that this electoral college vote will be the most consequential vote of his career...
Now, why on earth would he say a thing like that?
If he plans to vote against his own party’s President
If he plans to vote to betray his Republican constituents
If he plans to vote to uphold a clearly stolen election
If he plans to vote to sell America out to the CCP
If he plans to scuttle the Republican Party by helping the Democrats win
If he plans to sabotage his own efforts appointing conservatives to the courts
If he is doing something so shameful - Why on earth would he draw attention to it by calling it the most consequential vote of he’s career?
It doesn’t make any sense...
Unless... he plans to vote against Biden and he is playing some sort of game.
Something is up - I have no idea what - but it just makes no sense that he would say that.
It is so important to get this right: the Legislatures DID NOT send alternative slates. Rather, on the day the EC met, the Trump electors went to the respective capitols and voted as they would have if Trump were the certified winner. So the alternative slates exist, but not by act of the Legislatures
As a citizen of the country to your north, I agree 100% that VP Pence has the fate of the world resting on his shoulders. If Xi JinBiden Joe and Heels-up Ho become co-Presidents, not just the USA, but Canada, and the world becomes nothing but the CCP’s play toy, there for the dictators of Communist China to rob and abuse, as they see fit.
Prayers up for the legal counter-coup against the would be usurpers.
