Pence May Reject Biden’s Fraudulent Electors
Firebrand and freedom fighter Boris Epshteyn, a Trump 2020 adviser, is working overtime through the holidays to legally prove election fraud and rightfully overturn the results, namely, in Arizona.
Epshteyn, a regular guest on Steve Bannon’s “War Room,” said during his latest appearance on the number one political podcast in the country, that Vice President Mike Pence may reject the slate of electors he finds fraudulent during a joint session of Congress on January 6.
Boris was responding to a question about how President Trump can still prevail.
“So when the time comes on January 6…” the Vice President can count the “correct electors…the electors based on the most legal votes,” Epshteyn said on Steve Bannon’s “War Room” podcast. “Let not forget that a week ago today, the Trump electors were sent to Congress…along with the Biden electors,” he continued. Epshteyn later said the Trump team is prepared to fight well past January 6 if Congress cannot certify a winner.
This is significant since Vice President Mike Pence is tasked with reading each states’ electors into the official record during the Joint Session of Congress on January 6.
Some legal scholars have argued that where there are disputes over electors, the vice president has the legal authority to read into the record only that slate of electors which he believes is correct.
There’s discrepancy between legal scholars who say the vice president has no such power and may only read the slate of electors transmitted to the Congress by state officials. The answer to who wields this power or not falls within the open question of law that must be decided by the Supreme Court of the United States.
SCOTUS has never ruled on this issue in history. However, if Pence rejects some of Joe Biden’s electors, this could be the first time in history the highest court in the nation resolves this question.
Common sense is all one needs to know the electors sent by state of PA are based on fraud and therefore Pence can reject them. Don’t need a court ruling.
Read Hayes election. It spells out just what can happen. Only thing that’s changed is the 1878 ruling by SCOTUS the fraud vitiates everything.

Pence could flip the script in Wisconsin where a judge has put the burden of proof on DjT to prove the 215,000 COVID absentee votes have been ruled invalid, but must be individually examined before discarded.
Pence could warn them that the WI electors coming from the state legislators unless election officials prove they ARE valid properly placing the burden upon where it belongs. Reviews would be conducted under watchful R eyes.

Not according to the US Constitution, which specifically excludes judiciary from event on January 6th.

Since the petition is being run at the White House web site, the Insurrection Act is on the table, not that Trump will use it.

Fraud only has to be established ONCE
I don’t know what will happen. But the SCOTUS already decided they don’t want to be involved. It would be pointless IMO for anyone to count on SCOTUS slapping down Pence (if he were to go this route).
Trump and Pence could just tell SCOTUS that they don’t have jurisdiction. End of story - BOOM!!
He gave a pretty firey speech today at Turning Point event. Indicated he would fight to the end.
At that point in time, constitutionally, the president has the authority to order the House and Senate to disregard all illegal EC votes from contested states.
Invoke the Insurrection Act and the courts will toss it out in a matter of days. But if Trump wants to declare martial law then he can toss the Electoral College, the courts, the Congress, and remain in office as long as he wishes.

Pence is counting the votes sent by the states via the Electoral College.
There simply are no “competing” certified electors for any state at the moment - unless one or more states grows some cajones and submits two slates before 1/6.
So, to your questions..he has no choice, per the US Code. There is only 1 slate per state to count. There are no conflicts."
I'd recommend reading the OP. This is about Pence counting votes. Right? That hasn't happened yet. Jan 4th hasn't happened yet.
The entire point here, is that the states can, lawfully and Constitutionally, send an updated slate of electors to the feds.
The point THEN becomes, does Pence ignore the original slate (i.e not count them) and go with the updated slate that the states sent? He can...and he should.
As we've seen, there is a small, but growing push to get the states to do just that. And they will never get there if everyone throws their hands in the air and says it can't be done.
January 6 will be a very interesting day.

It seems plausible in a narrow and technical way. However, I think it would take an explosive revelation of election fraud to make it *politically* feasible for the VP to do something so extraordinary.
BTW, whatever happened to the DNI report on the election? I thought it was due last Friday but I haven’t seen anything about it. It was expected to be a big deal.
