Justice Samuel Alito agreed on Thursday to review an appeal against the ruling of the Pennsylvania Supreme Court that tossed a suit alleging the state’s mail-in voting was unconstitutional.

No it doesn’t, it’s genius by Alito because the safety harbor deadline is the 8th however would only apply if the electors/election is not in dispute which it will be on the 9th, which contests the electors.

Only remedy in PA short of the legislature recalling the electors has to come from the USSC..
The pa Supreme Court violated their state constitution and the separation of powers in many rulings before the election. The lawsuits challenge these rulings so do you thin the PA Supreme Court is going to rule it violated the constitution and the law in rulings it made in the last few months?
It is time for him to show it again.

Alito is setting up the state of Pennsylvania. If they don’t respond by the 9th they are set up for January 6th. The constitution clearly states that all disputes must be resolved by the 8th. The state is under dispute by the state legislatures right now and Gov won’t resolve.

Alito doesn't get to rule on the merits, only the full Court does. As Circuit Justice for the 3d Circuit, he gets to rule on motions (to shorten time, to grant a stay, etc.).
Here, the Pennsylvania Supreme Court refused to enjoin the certification of Pennsylvania's electoral votes. The challenger asked Alito to stay that decision. Alito didn't grant a stay, but set a date (Dec. 9) for Pennsylvania to respond to the motion for a stay, and December 10 for the challenger to reply.
If Alito ultimately doesn't grant a stay, or doesn't rule on the motion by December 12, the motion becomes moot because the Electoral College meets on December 12.

“In my mind-reading exercise, Alito giving the respondents’ enough time to fully prepare opposition likely means he and some other Justices take the matter seriously, and plan to rule on the merits once the opposition is submitted, rather than limiting their ruling to emergency injunctive relief. They could treat the Emergency Application as a Petition for Certiorari, accept it, and rule substantively. The few days gives the Justice enough time to prepare their respective opinions — it’s not like they really need briefs from the respondents to know the counter-arguments.”
