Carter Page files $75 million suit agains DoJ, Comey, FBI over 'unlawful surveillance'

Former Trump adviser Carter Page has filed a $75 million lawsuit against multiple high-ranking Department of Justice officials—including the Department of Justice itself, the FBI, James Comey, Andrew McCabe and several others—over what the suit claims are violations of Page's Constitutional rights stemming from surveillance carried out on him years ago.

The lawsuit seeks "accountability and damages against the individuals and agencies" who reportedly wronged Page via "unlawful surveillance and investigation." The suit alleges that Page was targeted for surveillance "because of his lawful association with the 2016 Presidential campaign of Donald Trump."

The suit argues that "four false and misleading warrant applications" permitted government officials to "engage in electronic surveillance" of Page. The Justice Department has conceded that it had insufficient evidence to justify at least two of the four warrants used against Page.

The defendants in the case, the suit claims, "fabricated or intentionally disregarded critical evidence, and misled the [Foreign Intelligence Surveillance Court], in order to obtain the FISA warrants".

"This case is about holding accountable the entities and individuals who are responsible for the most egregious violation and abuse of the FISA statute since it was enacted over forty years ago," the lawsuit states.

This will be rapidly dismissed as having no legal basis. The surveillance was lawful because he was a Trump associate and therefore a racist and homophobe. Did I mention that he was a Nazi? (/liberal mediot)

I want to know “Where is the United States Attorney”?

This isn’t a piddling mistake, like a wrong address transcription error on a search warrant. This was deliberate illegal use of the NSA/CIA/FBI assets for political spying. This DWARFS Watergate.

I believe he has a great case.

If they had only done the first FISA he would likely be out of luck. The FACT that they found nothing during the first FISA (a requirement for subsequent court orders) AND we know they found a treasure trove of exculpatory information and negative info for their source(s) and hid that from the court in the 3 additional FISA’s means his 4th Amendment rights were thoroughly trampled on.

I expect he will win this easily and further discovery will be interesting. “IF” Durham shuts down his investigation, Page will legally have access to his notes, documents, and interviews. This is why I do not think Durham will “shut down”.

Can he really sue the perps directly? I’d have assumed he could sue the government but not the guys who signed off on it. I hope it sticks, clearly these guys have nothing to fear from the DOJ, Wray and Barr have their backs fully. The only hope to make them pay for their crimes is maybe this.

Generally, when officers seek a search warrant, they get “qualified immunity” when someone sues. However, if an officer lies to get the warrant, he can lose that qualified immunity, because lying is outside the scope of his duties. (I hate putting that line in, because it will attract the cop haters.) The question will be asked: “Would an officer with similar qualifications and experience have done this?” If the answer is no, then the officer, or in this case officers, are going to be toast, because they knew, or should have known, that they were falsely accusing Page of being a foreign agent. And because of that, they are PERSONALLY liable.

Good! SOMETHING needs to go to trial. Cross examination under oath is the biggest friend the law has.

Virtually NONE of the kabuki charades of the past four years has gone to trial. One of the 16 russkies who were charged with meddling were put on the stand, even though one of them begged to be. The US AG’s office immediately dismissed the charges.

I agree with what you said, I'm just curious as to the 5-"W's" (who/what/when/where/why.)

The only LEGAL case I know of, that touches this subject matter, was Randy Weaver. Also when this finding that a cop / "COMPLAINING WITNESS" loses his "implied immunity" when lying, was at / in the 9th circuit circus.

Just curious, if there is another case on point?

It’s an old case, but it happened on the East Coast, and I think it was in New Jersey. An officer knowingly gave false information for a search warrant. When the dust settled the officer was found personally liable because what he did was outside the scope of his duties.
