The federal law that standardized federal elections dates from the 1840s. It states that federal elections must be held in all states on the same day. This is why no re-vote is legally possible. The Supreme Court cannot order a re-vote unless it decides to legislate from the bench. Only Congress can order a re-vote if the president signs it in to law. Keep in mind that certain dates are hard-coded in the Constitution and can't be changed except by constitutional amendment. This is a limiting factor.

The only thing that the Supreme Court can do is follow its 1877 precedent based on the events of the contested election of 1876. The Court can remand the choice of electors to the state legislature, a plenary and nonjusticiable power that Article II of the Constitution confers to the legislature.

The key words aren’t the ones in yellow highlight; they’re Alito saying that the court wasn’t aware (and was therefore surprised) that the October 28 order had been changed and that the Secretary as of the time of the order wasn’t able to say that the counties were segregating as the order supposedly told them to do. If she couldn’t attest to that yesterday, it’s hard to see how she could attest to it now.

This is actually *very* interesting language.

What I wonder about is mixing legitimate ballots with tainted ballots. How could you ever sort them out properly?

Is there any evidence anywhere that any of these counties are doing a separate count of any ballots at all, as the Secretary’s October 28 order supposedly told them to do? That order clearly contemplated, as it had to, that there would be one group of ballots counted, and then a separate count of another tranche of ballots. Maybe I missed it, but there hasn’t been any indication of any separate count at all. Certainly the Secretary’s office hasn’t been reporting two counts; they’ve been reporting one all along.
