Supreme Court Rejects GOP Appeal, Allows Democrats to Extend North Carolina Vote-by-Mail Deadline

The Supreme Court has voted 5-3 to deny a request by Republicans to overturn a decision by Democratic authorities in North Carolina to allow mail-in ballots to be counted nine days after Election Day and without a witness signature.

Justices Neil Gorsuch, Samuel Alito, and Clarence Thomas dissented, though only Gorsuch and Alito signed the dissent. Newly-sworn-in Justice Amy Coney Barrett did not participate in the decision.

As Breitbart News previously reported:

Democrats engineered the changes to mail-in voting through a “consent decree” between Democratic Party-aligned groups on the one hand, and state election authorities on the other. The state elections board is led by a Democrat appointed to the role.

Normally, mail-in ballots are counted in the state if they arrive up to three days after Election Day, and have a witness signature.

Chief Justice John Roberts and Justice Brett Kavanaugh joined the liberal justices, though for reasons that are unclear. One blog speculated that Kavanaugh wished to show deference to the North Carolina State Board of Elections because the state legislature had delegated rule-making power to it.

The rats have months to get votes in and they can’t. If they aren’t going to cheat they have no chance with NC no matter how long the polls stay open. The NC legislature is disastrous. They can just fix the law

ACB will only be one vote the ruling will still be 5-4. Very dissapointed with the Kavanaugh anr Roberts.

Trump got bad advice in picking Kavanauhgh and should get him and Robert off the court as soon as possible

Congress has specified the Tuesday following the first Monday in November. Seems like only Congress has the power to change that.

NC had no mass mail out of ballots. Absentee ballots have to be postmarked by election day, signed and notarized.

If this is fact i’d feel a whole lot better.

The NC Legislature has all the authority they need under the U.S. Constitution:

Article II, Section 1.2 ...

Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress ...

Most people don't know this, but under the U.S. Constitution individual citizens don't even have the right to vote for President.

If a state legislature wanted to appoint their own slate of electors without having any vote on Election Day, they are perfectly free to do so.

its been noted that SCOTUS wants to make a final sweeping, definitive ruling on VBM and deadlines after the election if necessary...

that will affect ALL STATES, not just individual ones.

The vote was 5-3, so even if she had participated and voted with Thomas, it wouldn’t have changed the outcome.

You would be wrong. If the state delegated rule making authority to the board it is not the place of the Supreme Court to gainsay the legislature. The problem is that often rule making authority is given without limits to that authority being made clear. Poorly written laws result in broad interpretation of rule making authority. It is not the job of the court to fix that.
