The Supreme Court has voted 5-3 to deny a request by Republicans to overturn a decision by Democratic authorities in North Carolina to allow mail-in ballots to be counted nine days after Election Day and without a witness signature.
Justices Neil Gorsuch, Samuel Alito, and Clarence Thomas dissented, though only Gorsuch and Alito signed the dissent. Newly-sworn-in Justice Amy Coney Barrett did not participate in the decision.
As Breitbart News previously reported:
Democrats engineered the changes to mail-in voting through a consent decree between Democratic Party-aligned groups on the one hand, and state election authorities on the other. The state elections board is led by a Democrat appointed to the role.
Normally, mail-in ballots are counted in the state if they arrive up to three days after Election Day, and have a witness signature.
Chief Justice John Roberts and Justice Brett Kavanaugh joined the liberal justices, though for reasons that are unclear. One blog speculated that Kavanaugh wished to show deference to the North Carolina State Board of Elections because the state legislature had delegated rule-making power to it.

If Democrats are up to their shenanigans, the NC Legislature can simply appoint their electors and have them vote for Trump when the Electoral College meets.
She will be just needs time to become familiar with the case. This isn’t over.

Kav and Roberts are moderates. Better than liberal or ‘nutcases’ justices like the three Dems. But sometimes plain wrong.
The overarching goal is not to change the rules at the last minute- which it is now.

It appears that her participation would not have effected the final result since it was 5-3 against. So the best result would be 5-4 against.
So... the legislature required a witness signature, but the courts now say its not required ? Is that right?

The ruling was 5-3 DO even if Amy votes with us it would still be 5-4 against us because of Kavanah!!
Its going to be a 4-1-4 Court with Roberts playing the role of Souter and Kavanaugh the new Kennedy swing vote. The Republicans will regret having defended him. It didnt take him long to turn in favour of those who assassinated his character.
This boils down a shadowy type of harvesting! Okay by the SC ...sad
Like it or not, each state can make their own rules, including making them up as they go along....which is the demo way. This is what you get with originalists.....they wont legislate from the bench.

That’s why Kavanaugh voted the way he did. The rules were decided by an election board for the state. It wasn’t a Judge overturning the legislators. It seems NC isn’t as bad as PA, even though they have a longer extended date.
NC had no mass mail out of ballots. Absentee ballots have to be postmarked by election day, signed and notarized.
She wasn’t on the court for arguments and therefore can’t rule on the merits.
[Someone remind me of a Democrat-appointed Supreme Court Justice in our lifetimes that have gone rogue.]
I thought last week the court ruled with us on NC what the hell happened??
