North Carolina GOP again asks Supreme Court to block mail ballot extension

North Carolina Republicans on Wednesday filed a second request to the Supreme Court asking justices to block a six-day mail ballot due date extension in the key battleground state.

The latest effort seeks the reversal of North Carolina’s top state court, while a similar petition filed last week by President Trump’s reelection campaign and state GOP members is aimed at blocking lower federal court rulings that relaxed the received-by deadline for mail ballots.

Both requests are now pending before the Supreme Court, which after the arrival Tuesday of Justice Amy Coney Barrett now has a 6-3 conservative majority.

The GOP in both instances is asking the court to effectively block a state court-approved agreement to push back the deadline for the receipt of mail ballots by six days, from Nov. 6 to Nov. 12, for ballots that are postmarked by the Nov. 3 Election Day.

Roughly 1.4 million voters in the state requested mail ballots for the upcoming election, which is almost seven times as many requests compared to this point in 2016, according to the Raleigh News and Observer.

North Carolina is one of several key battleground states where the Trump campaign and other Republicans are fighting against eased mail voting restrictions. GOP-allied groups argue that an uptick in mail balloting due to the pandemic opens the election to widespread fraud.

The Wednesday petition from North Carolina Republicans heavily cited concurrences filed by Justices Brett Kavanaugh and Neil Gorsuch in a 5-3 ruling Monday in which the court’s conservative majority rejected a Democratic bid to reinstate a mail-in ballot due date extension in Wisconsin.

I wonder if now that there is another Conservative Judge, that Roberts now goes full hard core leftist on us? I do indeed suspect his behavior to change. Even if they have to kill his dog to do so.

I cautioned earlier to not take Justice Barrett for granted. She will be under pressure, at least in the initial days, to show her ‘neutrality’.

I can’t see the court changing the rules less than a week before the election. Maybe make it clear that such extreme extensions won’t be allowed in future.

Keep a close eye on those late ballots though.

If five justices agree to hear it, it is then heard.

Roberts can be one of the majority or minority, but I count five conservatives:

Thomas
Alito
Gorsuch
Kavanaugh
Barret

I do not understand that if the written law says all ballots must be postmarked by election day that some or any judge can rule that the law is void.

Can he/she/they rule that heroin is legal? Murder is ok? Shut down a newspaper that writes bad stuff about the government? Order a citizen put to death?

It’s ridiculous that this is even an issue.

This is like playing Whack a Mole. Meanwhile fake ballots are being counted all over the place. The USSC needs to issue a blanket ruling on ballots being in by election day.

I certainly can’t tell with certainty

Folks here think that Hillary/Obama had something on him. It may be that the treat will dissipate. It may be there is no threat. If Biden is elected, the results of the threat might intensify.

However, for now as conservatives, Roberts is no threat where it counts

We actually need to lay off of John Roberts just a bit.

Judges are like building inspectors; some do a quick look and scribble their signature; some look for certain things and nail the builder. In such cases, the builder learns to do those things right in the first place.

Roberts looks for certain things and makes decisions based on tight language. He went against PA republicans for some language, and went with them in WI for different language.

So, if you don’t want him chucking your papers back in your face, do your homework.
