WASHINGTON (AP) A divided Senate is set to confirm Amy Coney Barrett to the Supreme Court, giving the country a ninth justice Monday as Republicans overpower Democratic opposition to secure President Donald Trumps nominee the week before Election Day.
Democratic leaders asked Vice President Mike Pence to stay away from presiding over her Senate confirmation due to potential health risks after his aides tested positive for COVID-19. But although Pence isnt needed to break a tie, the vote would present a dramatic opportunity for him to preside over confirmation of Trumps third Supreme Court justice.
Senate Democratic leader Chuck Schumer and his leadership team wrote that not only would Pences presence violate Centers for Disease Control and Prevention guidelines, it would also be a violation of common decency and courtesy.
But Senate Republicans control the chamber and Barretts confirmation isnt in doubt.
The 48-year-old Barrett would secure a conservative court majority for the foreseeable future, potentially opening a new era of rulings on abortion, gay marriage and the Affordable Care Act. A case against the Obama-era health law is scheduled to be heard Nov. 10.

Rules are only for republicans, dontcha know?
Pence.. don’t waver and show up!
Schumer is trying to set up some sort of precedence, to scam Republicans at a later time.
Shmuck is trying to engineer a 50-50 split....................
Swear her in tomorrow morn so she is ready to go when the mail in fraud starts to roll in. Too bad she was not sworn in before Roberts went rogue again a few days ago and went with Dems in affirming PA extension to receive ballots 3 days beyond election day
The vote last night or are we waiting for them to vote today? If so what time?
She can be sworn in within minutes of the vote.................
Thats right she said she would be off the campaign trail but that only lasted for about 1 week I think.
The lefties can scream and get thrown out by the Park Police if they create too big of a disturbance for the other tourists. But they won't be able to intimidate anyone or vandalize anything.
The lineup will be:
LIBERALS — Kagan, Breuer, Sotomayor
CONSERVATIVES — Alito, Thomas, Barrett, Kavanaugh, Gorsuch.
And then there is John Roberts, who knows what he is.
But when is the vote?!
According to the "live" thread, "Senate Roll Call Vote No. 222 says the vote was at 1:04 p.m., add 30 hours to that and we get 7:04 p.m. as the time the 30 hour clock runs out."
I would guess the vote would come shortly after 7pm EDT today. I put live in quotes 'cause it's not live now, just rereuns of the nomination hearings.
Tip of the hat to Harry Reid.
Gorsuch has sided with the libs to stretch civil rights to include whatever perversion is practiced.
This afternoon, or this evening, unless Schmucky pulls a fast one, like a grandstanding walkout.................
Thank you :)
Yes. And almost ALL gop senators voted for Ruth Bader Ginsburg.
Then we should say, there are 3 liberals, 4 conservatives, and then Gorsuch and Roberts are wild cards.
Well, couldn’t we bet on that? He’s a schmuck as you noted. Damn.
The lower courts could play their games with the tie vote in play and really invalidate the election.
My guess... Pelosi is active behind the scenes thinking up law suits.

Since the VP doesn't seem like the guy to wear a "**** You" t-shirt (or any kind of t-shirt to the Senate), maybe an "Up Yours!" button would work.
Happy birthday, Hillary!
