With Amy Coney Barrett expected to join the Supreme Court as early as next week, the court’s action in a Pennsylvania voting case has heightened fears among Democrats about the court being asked to decide a post-election dispute and with it, the winner of the White House.
The justices split 4-4 Monday over a Republican plea to undo a state court order and force elections officials to ignore absentee ballots received after Election Day, Nov. 3. The tie vote left the Pennsylvania court order in effect and allows mailed ballots to be counted if they are received by Nov. 6. Chief Justice John Roberts and his three liberal colleagues voted to leave the court order in place.
The four conservative members of the court who would have granted the GOP’s request are likely to be joined soon by Barrett. That’s a potential majority, even without Roberts, in any election-related dispute, whether from Pennsylvania or any other battleground state where mailed-in ballots or a recount fight could decide the winner.
“One more vote, provided by a hard-right, Trump-nominated justice, could be the difference between voting rights and voting suppression,” Senate Democratic leader Chuck Schumer of New York said Tuesday. …

Perfect reason why ACB MUST be confirmed before the election: we can’t let lower courts decide important cases like we may see about the election.
Confirm ACB and bring the case right back to the Supreme Court for a revote.

There was just a much worse ruling for NC. I guess now we can try to wait until Barrett is seated to appeal it to the top?
I think it’s likely that PA decides this race, and it will be a court case.

Mark Levin said last night that the legislature of Pennsylvania should immediately pass a resolution declaring the Pennsylvania Supreme Court ruling null and void, citing their Article II power to set election law regarding federal Electors to the Electoral College.

Don’t know the law in Penn. with respect to when ALL ballots must be counted but it would seem to me if actual in-person vote tallies were let’s say delayed for a day or so, it just might throw off what the rats “need” to pull a fast one.
The error in the Pennsylvania GOP case was that they argued to overturn the state court order, which gave Roberts the room to side with the liberals.
The GOP legislatures must argue Article II Section 1 separation of powers and make Roberts rule against their plenary Constitutional power to make Electoral College election law and FOR judicial supremacy.

The Left never gets it wrong - even a Justice with Kagan’s intellect doesn’t suddenly switch gears and start overruling liberal decisions using Constitutional logic.
