SAN FRANCISCO (CBS SF) A state appeals court ordered San Quentin State Prison on Tuesday to immediately cut its inmate population by half, which would require transferring or releasing about 1,700 inmates, citing the states inability to manage a deadly COVID-19 outbreak at the prison.
The First District Court of Appeal in San Francisco ruled that the California Department of Corrections and Rehabilitation (CDCR) and San Quentin Prison Acting Warden Ron Broomfield have acted with deliberate indifference and relief is warranted, the court opinion stated.
The ruling stemmed from a case involving 64-year-old Ivan Von Staich, who along with his 65-year-old cellmate, tested positive for the virus in July. Lawyers for Von Staich, who was convicted of murder in Southern California in 1983 and sentenced to life in prison with the possibility of parole, argued he had not had any disciplinary incidents since 1998 and the state parole board was likely to grant him release.
In August, the same appeals court ordered CDCR to justify its refusal to remove inmates with heightened COVID-19 risk factors from the 150-year-old prison.
There have been more than 2,200 confirmed cases of COVID-19 among San Quentin inmates and 28 inmate deaths. In addition, nearly 300 San Quentin staff members have been infected, resulting in one death. Tuesdays court ruling called the outbreak the worst epidemiological disaster in California correctional history.

Just in time to loot and murder after the election.
Tuesdays court ruling said the CDCR was in violation of the Eighth Amendment, which prohibits cruel and unusual punishment.
Its only cruel and unusual if its not treated if and or when they get it. Who better to prove hydroxychloquine and zinc works then on scumbag criminals!
Outlaw the death penalty so the worst criminals can train the next generation, and then use a pandemic for an excuse to release the worst back onto society.
What a state!
Insanity.
whats the problem...just give em all masks...right.
They can’t manage an outbreak in a prison, but it’s easier to manage it when they are running free??? Only in America!
Here’s what happened - another bad decision by state officials: “San Quentin was COVID-free until late May, when officials transferred 121 inmates there from the California Institution for Men, site of the prison systems largest outbreak at that time...” https://www.msn.com/en-us/news/crime/court-san-quentin-must-release-prisoners-due-to-lack-of-covid-care/ar-BB1aeHUH At least 15 of those transferred tested positive and that’s when it started roaring through San Quentin.
Did the appeals court also rule that the released inmates should be given firearms? (After all, they’d need tools of the trade to earn a living on the outside.)
Just asking for a friend who lives in California.
So if you are already locked down and come in contact with covid you need to be set free. If you are free and come into contact with covid you need to be locked down.
It’s time to lock up these criminal judges
But not with antifa.
These are experienced criminals who can’t afford to get arrested again...(well, there they can :) )
They will go back to their respective hoods and do damage.
It ain’t the problem that they’re tough.
The problem is a lot of them are crazy...and have done and will do most wouldn’t dream of.
Jail or prison isn’t horrible because your confined.
It’s horrible because you’re confined with many sick animals.
If you’re a decent hard-working American and not already out of California or have an escape plan I’m afraid you are running out of time.
All the good citizens of SAN FRANCISCO need to all show up in this court at the same time. It is the only way to stop radical courts and judges.
Do they have to promise to come back after the pandemic ends?
Or are their crimes forgiven and sentences reduced to time served?
Really are there any left there?
It worked in Kenosha.
