Chief Justice John Roberts joined the liberal wing of the Supreme Court in rejecting an application for a stay that was requested by Republican lawmakers in Pennsylvania.
The GOP asked the Supreme Court to put a stop to a state Supreme Court ruling that extended the deadlineby three daysfor receiving and counting mail-in ballots for Novembers presidential election.
But the 8-justice Supreme Court on Monday denied the application for the stay. The order only said that conservative Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh would have granted the application.
There was no other message, leading us to the necessary conclusion that Chief Justice Roberts, and liberal Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan denied the application.
The Supreme Courts rules say that five justices must vote in order to grant a stay. Here we had a 4-4 tie.

“Waiting to confirm” Barrett? Graham is turbo-charging the Judiciary Committee process, even scheduling a Sunday session. What did you want him to do, send the nomination to the floor without hearings? Not only would bypassing hearings for a SCOTUS nominee for the first time in over half a century hurt Trump and other Republicans in the elections (it would be the only evidence to which RATs could point credibly of the process being unfair), but those hearings have been the best advertisement for Trump’s reelection since the start of the campaign. ACB will be on SCOTUS before Halloween and will form part of the SCOTUS majority that blocks Democrat attempts to violate federal law or the Constitution, including in Pennsylvania.
“Roberts becomes irrelevant with the exception of deciding which cases to bring before the court (I think thats the job of the Chief).”

No, certiorari can be granted by the vote of any four justices; the chief justice has no special power there. The only special power that the CJ has is to appoint the author of the Opinion of the Court *when he is in the majority*. If there’s a 5-4 decision with Roberts in the minority, Justice Thomas (as the senior-most justice in the majority) gets to assign the opinion (which can be to himself).
And while Roberts has been disappointing, it is silly to claim that he’s now filling Ruth Bader Ginsburg’s role on the Court.
He acts like someone who is compromised.
The old excuse about federal judges simply does not hold water. I will personally never forget Bush giving us Roberts. W is a turd who is no better than Obama.
I heard it would be Oct. 23. Now it’s 26th? :(
But...but...Graham already told the Democrats that they’ll probably win the election! He’s delaying this as long as he can to please them. You’re right, ACB should have been confirmed by now.
This guy has been a serious disappointment almost from Day One.
Much like the guy who appointed him. (sigh)
David Souter Redux. The Bushes have been a curse on this country.
Because Gore or Kerry would have been so much better...
He is such a complete jerkoff... I wonder what kind of blackmail info the dems have on him?
Roberts is just like John McCain, but in the SCOTUS.
Stabs us in the back at every opportunity.
Yeah, no doubt, but that’d leave — what— eleven people in Congress, our something like that?
If Gore or Kerry did not start a war in Iraq, it is possible.
That would be a win.
Then they couldn’t meddle in our lives so much.
I remember when statements like that here would require flame retardant underwear. Times they do change like Linda 2.0 is beginning to disappoint those that thought he changed, for that matter some are waking up to the real Barr, Durham, Wray and Sessions.
They won't even investigate Hunter or Joe and you expect them to touch Roberts?
There have been three presidents I actually voted for Nixon, Reagan and Trump, the rest of my votes have been against the other guy, because the other guy would have been far, far worse. Let's be realistic isn't that likely the reason most politicos have their jobs?
