Flynn Legal Team Files Motion to Disqualify Judge From Case Due to Bias

On Wednesday, former National Security Advisor Lt. Gen. Michael Flynn’s legal team filed a motion to remove U.S. District Judge Emmet Sullivan from the case.

The basis for the motion was that Sullivan has shown “contempt and disdain for the defense,” according to Just the News.

 

Flynn’s attorneys, Sidney Powell and Jesse Binnall, filed the motion after a hearing last week saw the several clashes between the judge and the defense. Flynn has also tried to get the D.C. Circuit Court to issue a writ of mandamus forcing Sullivan to drop the case. The full court sided with Sullivan’s appeal after a panel from the D.C. Circuit sided with Flynn.

The Justice Department has been trying to drop the case against Flynn for months, but Sullivan has continued to refuse.

The motion, which can be read in full here, argues that Sullivan’s tenure as judge over Flynn’s case reeks of bias and clearly meets the standard of recusal, concluding that:

“Judge Sullivan’s increasingly hostile and unprecedented words and deeds in what has become his own prosecution of General Flynn mandate his disqualification from further participation in these proceedings and the referral of his conduct to the D.C. Circuit Judicial Council… The appearance of bias here is terrifying and mandates disqualification.” 

No one deserves to be treated as unfairly as General Flynn has. He was coerced into pleading guilty to a crime he did not commit, and even the Justice Department realized this and agreed to drop the case.

 

Judge Sullivan knows this. The fact that he won’t let the prosecution drop its own case speaks volumes about what his true objective is.

I’m not always a big fan of this sort of thing, but in this
case it is so clear the judge is in the tank for the left,
there’s no other choice.

I wish Flynn luck with that.

This absurdity needs to end.

IMO > this judge should be brought up on charges, and wind
up in prison for a considerable length of time.

Agree 100%

I have never seen a court case where the Prosecutor move to drop a case and the Judge refused. Moreover, the Judge than behaved like a Prosecutor.

He Can’t just Give the Bribe Money Back, he has to fight, maybe literally for his life in this case.

Powell specifically requested President Trump NOT pardon Flynn because she is absolutely certain Flynn will be vindicated and found factually innocent.

Likewise Sullivan will be removed from the case.

The question is, before or after the Election. Unfortunately, most likely, after.

I agree with your comments there. I haven’t seen it either,
but I’m not a frequent observer of court proceedings.

It does sound to me like this judge has gone rogue here
though.

When a judge has clearly gone around the bend, those who
seek to interfere with him being taken to task, could be
seen as parties to the crime after the fact.

The insanity of this could spread within the judicial
community and cause tremendous damage to respect for
judges across the board.

This guy has nothing more than a personal vendetta going
for him. Does the judicial community wish to defend that
sort of thing?

Good luck with that.

Dirty cops, judges, whatever, can really cast a pall over
the decent members of their profession.

These folks better think long and hard on this one.

If they think they aren’t next in this meltdown we’re
observing, they better think again.

Absolutely. Sullivan is the type of Democrat that gives it away for free in support of Team Obama. No bribe money need be involved.

Do you have evidence that Sullivan is being bribed? If not, then you need to back down. If you have no proof, then you are engaging in slander.

Everybody is not motivated by money. There are plenty of evil people in the world that will engage in this sort of travesty for free.

Meanwhile, people who just assume that money is involved; e.g. you, should keep your conjectures to yourself until such time that actual proof is found.

What leaves me speechless, is that Sullivan was the judge who reamed the feds for withholding evidence in the Stevens trial, now he suddenly “is shocked, shocked I tell you”, that anyone in the DOJ could have withheld Brady materials again.

If he is replaced, and that’s a big if, it most likely will be with Amy Berman Jackson.She is much worse than Sullivan, if that’s possible. She definitely will be more vindictive.
