To me that seems like a mile-wide loophole for her to pick and choose how she rules, and thus in a sense legislates, from the bench.
At this point the Republicans are equally at fault, they have had plenty of time to come up with an alternative. Have they? No. What happens if the court actually does throw it out?
One SOTUS judge will rip apart a law all by her self. These people are stupid.

How a Judge May or May not rule on a case can not be used as reason to deny confirmation: this is well established.

I heard stefanophlous ask Mike Lee if Barrett would recuse herself for any cases that may make their way to SCOTUS having to do with the upcoming election. Lee missed the perfect opportunity to ask why didn’t Kagan recuse herself when SCOTUS was asked to rule on obamacare...
