Federal Court DENIES Gov. Wolf’s Stay Request.....(checkmate!)

A federal judge today (Tuesday) denied the Wolf administration’s request for a stay on the federal court decision that found some of Governor Tom Wolf’s COVID-19 pandemic restrictions to be unconstitutional.

The administration sought a stay on the ruling while also appealing the decision, which was issued by U.S. Western District Judge William Stickman IV last week.

.. the Wolf administration “did not proffer any specific evidence to differentiate between the danger allegedly posed by gatherings governed by specific numeric limitations and gatherings governed by occupancy limitations.”

I'm not sure how that works for other states....but you first have to have people willing to do the lifting as you know. Our guys got shot down the first try about Wolf expanding the Emergency state......but they turned around and went after him another way....(That's the Trump way you know! LOL)

I really think the only reason state Reps don't fight is they haven't had a leader to show them how you do it!.and not just take defeat.... Our guys have got it!

The denial of the stay was by the same judge who issued the stay, so expect an appeal by Wolf.

I’m against judges running our health systems.
As our Founders decided it is better to have ab elected Executive run things.

However, the ruling by this judge is very limited. It allows for emergency action- which an Executive needs whether the people have elected someone wise or not.
Orders that go on and on and on are not “emergency” orders and are subject to usual Constitutional limits.

That's where you then pick your fights....and don't stop with defeat the first time around.....if you need to take out an opponent then keep looking for opportunity...again and again. There's always another way if what you're doing is right.

They already fought Wolf’s expansion of emergency status....BUT they then passed a bill that no Governor in the future can extend a state of emergency past 30 days without approval.. Wolf abused the state of emergency to sustain his power and stronghold on PA,that gives a Governor extended powers during that time.

Wolf can never do this again!

Yes, it’s him...... .we’re fighting him but he’s fighting back as well.....recall I was livid right from the beginning of covid because Wolf and Cuomo had teamed up together....the lockdown in Pa was all about Cuomo running the show on the east coast. (with a Pres.Election forthcoming).

Wolf’s been an a** because he is one!

Here’s the timeline:

Mid March - Governor Wolf orders “lockdown” closing all restaurants and bars.

May - Governor Wolf begins a phased reopening, indoor capacity at 25 or 25%/outdoor 25 Lawsuit is filed in Federal Court

June - Governor Wolf allows more businesses to have 50% capacity and outdoor gatherings of up to 250

July - Governor follows the lead of Allegheny County (Pittsburgh) in reducing capacity of bars and restaurants to 25% because some “cases” were allegedly traced to bar patrons....same time frame as the sacrosanct riots.

Last week - Federal Judge Strickman rules the capacity limits to be unconstitutional. Wolf lets out a howl and files an immediate request for an injunction to set aside the ruling pending appeal.

Now - Judge says, “UP YOURS!” and refuses injunction.

So right now, unless you have a State issued license hanging like a sword of Damocles you can have as many people as fire codes permit for indoor gatherings and as many as you want outdoors.

Now is the time to sue your state and the governor for ALL lost revenues incurred due to their unconstitutional orders under the takings clause.

I’m sure they don’t have the liquidity to pay, so just deduct it from your state, local and property taxes going forward.

Wolf tucked his tail between his legs and kowtowed to Coma-tose, right down to following the script of packing nursing homes with CV19 patients.

As of today 66.8% of PA’s total COVID deaths have occurred in nursing homes...a percentage that exceeds those of NY and NJ.

Which is why for the past four weeks I've been making a point of posting the LTC death stats on D1’s daily thread...keep hammering away, exposing, and maybe even embarrassing this cretin.
