In Resurfaced Clip, Amy Coney Barrett Says it Would've Been Inappropriate for Obama to Nominate SCOTUS Judge Who Could 'Flip Balance of Power'
Newsweek ^

A resurfaced interview that CBS News conducted with Amy Coney Barrett in 2016 shows the former law clerk for Associate Justice Antonin Scalia warning against making changes that would "dramatically flip the balance of power" on the Supreme Court in an election year.

Barrett is reportedly one of President Donald Trump's top picks to replace Associate Justice Ruth Bader Ginsburg, who died last week.

At the time the interview originally aired, Scalia's death had caused a stir in Congress as senators debated whether it was appropriate to confirm the late justice's replacement in an election year during which the country was operating under a divided government, with President Barack Obama leading the executive branch and Republicans controlling the Senate under Majority Leader Mitch McConnell.

McConnell ultimately decided against moving forward in 2016 with Obama's nomination of Merrick Garland, who legal experts have said would have been a more moderate voice on the court, and waited for President Donald Trump to take office before replenishing the court's ninth seat. McConnell's decision was widely scrutinized at the time and has come into focus yet again in the wake of Ginsburg's death.

There is no balance flip. It’s a conservative court and it will remain conservative.

We already flipped the balance with Kavanaugh. This is icing on the cake.

Put this in the same category as RBG’s final wishes. Means absolutely nothing.

No, it would not have and I would have expected nothing less of any sitting president.

It was quite appropriate to hold back Obama’s choice to replace Scalia seeing as how Obama had him murdered. By the way there is not supposed to be a ‘balance of power’ by the court. They are supposed to follow the text and what was meant by the text. Anything else makes them a politician and not a Judge.

According to libs scotus was 5-4 ignring robers is not really a dependable one of the 5

Going 6-3 is not a dramatic shift, because this just gives us a true 5-4, and with tainted roberts, sometimes a 6-3

Well, this won’t flip the balance of power. It will strengthen it

What does she mean by “balance of power”? A balance between those who interpret the law as written and intended, and those that don’t? The balance that I’d like to see is 9 of the former and zero of the latter.

Getting elected means hoping to change the balance of power. Why the hell get elected otherwise?

Wow. Great post.

And the only one that really matters out of all of them.

Even we all forgot that.

They’re not senators or house members wanting to make laws.

They are just supposed to apply the constitution to the cases that are in front of them

I know a lot of people like her but the more I read about her, the more I think she is not the right pick. Sure, she would be great on abortion but her other rulings worry me. Look at the recent COVID lockdown ruling of hers.

Yes. What you said. Anyone who would vote to imprison free Americans in their homes -— well, I have no use for that person.

And O’bummer said if you like your health care plan, you can keep your health care plan...

And as Joe Biden said right before O’bummer signed it, “this is a Big F’n Deal!”

Rats are cornered.

Fill That Seat!!

I see it as being: 5-3-1.

Roberts does not fit into either category.
