I am not so sure it will fail. First, it is questionable whether senators Murkowski, Collins and Romney will go along with a pre-election confirmation.

She was at least nominally Jewish, so the funeral is supposed to be held within 24 hours. However, modern practice permits the time necessary for making arrangements, travel, etc.

This woman is definitely my pick for the Supreme Court. She has a Ginsberg-like determination but comes from a Constitutional view of the law, where Judge Ginsberg was a judicial activist based on her own opinions. Any woman who can combine the Motherhood of 7 kids with such a stellar career without an elitist background and Ivy League support should get 100% of the US Senate vote. Of course they are. Job #1, Biden must not win. Do note that even when Obama had a SUPERMAJORITY in the Senate (60 votes) he still wasn't able to get "card check" passed for the Unions. That probably shows the influence of the Deep State and Big Business Money more than anything, but it does mean there are some checks on the craziest of the crazy lefties.
