BREAKING: President Trump will put forward, in the next few days, the name of his nominee for Supreme Court Justice to replace Justice Ruth Bader Ginsburg, according to to sources close to President Trump, @ABC 's @byronpitts reports.

“Over American history the size of the court has varied,” Winkler said, “from six members to 10 members to seven members to nine members. There’s nothing magic about nine.”

With an eight-justice court, a majority decision requires a 5-3 vote. If the supreme court is deadlocked 4-4, the lower court’s decision in the case is upheld but it does not create a legal precedent.

Perhaps. But if you are actually handed a strong chance to be on the Supreme Court and have to weigh it against a dicey chance to be president....I think he takes the gig.

Did she actually say “ until after inauguration.”? If so she is conceding or perhaps hoping her own party loses the election. If not she should have said she would not make a decision on whether or not to consider voting for a replacement until after the election results are known. As stated she is saying no vote until January even if Trump wins. What a beatch. Thanks a lot Alaskans. You guys need to stick your heads in the microwave and hit defrost to thaw your brains out. Seriously, we need to focus on getting electable replacements in AK, NV, UT, and MN, and the brain donor RINO voters in those states need to go.

Judge Janice Rogers Brown is on the DC circuit. I haven’t followed her record but in her speeches she seems to be more aligned with conservative/libertarian principles. Don’t know how she is since being appointed to the circuit court though.

I absolutely agree. This us no time for America to see President Trump blink. That’s what the left wants, to see a glimmer of anything approaching deference on the part of him. They will attack him like a crazed pack of dingoes. He must show his strength in the face of this situation. Condolences and continuity. With no apologies

I suspect the president knew before it was released to the public.

I suppose that might be possible, but I don't think he would have gone so long with his rally. He also would have likely delay it until he could make a statement. I've been watching the rally that he is only finishing up now.

If there is doubt about confirmation, McConnell can recess the Senate for over 3 days and the President can make a recess appointment who could serve through the end of the next Senate session. The recess appointment would not keep the Senate from working on confirmation of a permanent appointee who would replace the recess appointee upon confirmation.

Teddy is NOT going to want to answer the questions .. like from Larry Tribe of Harvard, who said that Ted spent his time at Harvard claiming he was for the ‘original intent’ of the Constitution ... given what the Founding Fathers ‘meant’ by ‘natural born’ US citizenship.. nope Ted Cruz is NOT going to put himself in that predicament ...
