Think about this. What is a State? It's basically the name of an entity commonly called a country. Hence United States.
Think about one of these United States and it's government. Pretty much a mini version of the fedgov. Think about how much power a Governor has. Quite evident since covid-19. Very broad powers. They can declare a State of Emergency. They each have their own National Guard. They each have their own Constitution, Senate, House etc etc. They can even declare a group of people Domestic Terrorists. (was it NJ who declared antifa as such?)
That is how things are supposed to work.
Now what is a US president supposed to do about a single city in one of these fairly sovereign States? Insurgency act? Declare a NATIONAL Emergency over a few cities in individual States? Both overkill really and I'm SURE if he did either, Impeachment proceedings would start pretty fast. Even the US Senate might go for it this time because each State has the ability to take care of what's going on there. So anything the president does would be overstepping. That would literally be grounds for impeachment because it goes against the whole concept of the whole system that the Founder came up with.
That's the whole separation of powers thing and by design, the US president really doesn't have much power over the States. The Founders made it that way because they had just been under the RULE of a King and they wanted to make sure a single person could never have much power.
I'm sure Trump was asked his lawyers what he can and can't do.

At what point are the Democrat states considered to be in open insurrection? The local authorities are refusing to defend the local populace and enforce the local laws. They are either inept or in-cahoots.

Not sure why he doesn’t. Hopefully not for polling reasons. Only difference between what’s going on now and recent invocations of the act is that this is mostly smallish groups operating at night while the other instances were day and night and/or more widespread. 1968 was in over 100 cities and 1992 Los Angeles Rodney King, CA law enforcement couldn’t handle it.

Both cases above, the states couldn’t handle it and CA actually requested fed help. Different from now when the Govs simply refuse. Seems like antifa spends all night trying to set one concrete building on fire in Portland. Chicago has pretty much taken care of things themselves. Kenosha is newer and will now be taken care of hopefully. Denver and Atlanta are isolated.
I bet Trump’s lawyers or advisers have told him the Insurrection Act is only for very large disturbances that overwhelm the state and/or for when a state requests help.
DHS or whoever needs to declare antifa and blm domestic terrorists nationally.
That applies to Congress, not a president and it’s for Commerce.
Looks like the Insurrection Act could be used but traditionally has only been used for larger disturbances that overwhelms a State.

There is a guy today who is in prison who was fleeing for his life in his car in Charlottesville, VA. Some protester had a heart attack and now *he* is in prison.
We need to get rid of justices who understand what constitutional justice is all about.

I see extreme desperation in the Democrats...extreme...they WILL have the rioters attack to National Guard. They need to flip this and they think military shooting Antifa might be a chance - theyre throwing everything at the wall in their insanity.
