Donald Trump's campaign lawyer promotes 'birther' conspiracy theory that Kamala Harris is NOT eligible...

"Donald Trump's campaign lawyer promotes 'birther' conspiracy theory that Kamala Harris is NOT eligible to be VP because her parents were immigrants".

The Trump campaign's Senior Legal Advisor Jenna Ellis pushed a so-called 'birther' narrative Thursday that Kamala Harris isn't eligible to be vice president because her parents weren't citizens when she was born in Oakland, California.

'It's an open question, and one I think Harris should answer so the American people know for sure she is eligible,' Ellis told ABC News.

Ellis' views on the issue came to light after she retweeted a link to a 'birther' op-ed published on Newsweek's website Wednesday written by right-wing law professor John C. Eastman.

Eastman pointed to how Article 2 of the Constitution says only a 'natural born citizen' can serve as vice president and president, but suggests there's some interpretation of the 14th Amendment's Citizenship Clause that could exclude someone in Harris' situation.

He also argued that while the modern view of citizenship includes every person born on American soil, that belief started after Harris was born in 1964. 'Indeed, the Supreme Court has that anyone born on U.S. soil, no matter the circumstances of the parents, is automatically a U.S. citizen,' he also wrote.

Eastman had run as a Republican in 2010 for California attorney general, but lost his primary. Harris ultimately won the position as a Democrat.

Eastman's op-ed received tremendous backlash, with many pointing out that it echoed the conspiracy theory pushed by President Donald Trump and others during President Barack Obama's tenure.

Josh Chafetz, a professor at Georgetown University Law Center, called Eastman's interpretation of eligibility as 'racist nonsense,' in a FactCheck.org post on the controversy.

A question of Constitutional interpretation is hardly a “conspiracy theory”

Then sue. The sooner you file the sooner it can get thrown out for lack of standing.

Yup. Been there done that. I have to admit I was all in on it in 2012. Got us nothing but a President Obama.

Birther theory?! Neither of her parents were American citizens at the time of her birth, this is undisputed fact. She may be a citizen, but she ain’t no natural born citizen.

The 14th amendment was incorporated to settle the question of former slaves and their citizenship, not to give rights to citizens of other countries. But of course, that doesn’t matter either. No one follows the constitution anyway.

I share your cynicism. However, it still doesn’t mean that we are not correct on this issue. It’s just that it’s a fight we can never win because the courts, Washington, and the media are so corrupt.

“She was born a citizen of Jamaica, not of the United States. “

Nonsense, she was a citizen of the United States from the moment she was born.

Get ready for a spate of interminably long posts adamantly declaring her ineligible. Also accusing anyone who doesn’t join in on the tilting at windmills with the advocates of ineligibility of being an enemy of the Constitution, dupes, librals, ad infinitum ad nauseum.

As we’ve seen for over a decade with Obama none of this eligibility crap is going to fly. It’s pure distraction. Possibly by false flag demonrats.

Half a precedent was already set - Obama. His mother, at least, was an American citizen.

Avoiding setting the other half is worthwhile.

Not a good idea...even if they're correct. Osama Obama established, beyond doubt, that "natural born citizen" doesn't apply to Rats.Of course he did so through dishonest means but that doesn't matter.

As a result doing so makes him look small...petty...and even desperate

“Yup. Been there done that.”

Exactly.

No one voting for or supporting Biden-Harris cares about anything as quaint as the Constitution.

It’s a waste of time to debate it.

Focus on how these folks are aspiring tyrants who want to take our freedoms while destroying our economy.

Sounds like they are conflating a lot of words: natural born citizen = native born citizen = citizen

They are not all equal and mean different things, but the article seems to aim for lowest common denominator: citizen.

No agenda there by the media, eh?

It’s not a *birther conspiracy theory*.

It’s a fact.

Naturalization Oath of Allegiance to the United States of America

Oath

“I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty, of whom or which I have heretofore been a subject or citizen; that I will support and defend the Constitution and laws of the United States of America against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I will bear arms on behalf of the United States when required by the law; that I will perform noncombatant service in the Armed Forces of the United States when required by the law; that I will perform work of national importance under civilian direction when required by the law; and that I take this obligation freely, without any mental reservation or purpose of evasion; so help me God.”

Should less be required of a citizen born in the USA? The founders did not imagine that anyone who had dual citizenship would ever be elected to the Presidency of the USA.

“Neither of her parents were American citizens at the time of her birth..”

Both her parents would have had to be citizens at the time of her birth.
