Some Questions for Kamala Harris About Eligibility | Opinion

The fact that Senator Kamala Harris has just been named the vice presidential running mate for presumptive Democratic presidential nominee Joe Biden has some questioning her eligibility for the position. The 12th Amendment provides that "no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States." And Article II of the Constitution specifies that "[n]o person except a natural born citizen...shall be eligible to the office of President." Her father was (and is) a Jamaican national, her mother was from India, and neither was a naturalized U.S. citizen at the time of Harris' birth in 1964. That, according to these commentators, makes her not a "natural born citizen"—and therefore ineligible for the office of the president and, hence, ineligible for the office of the vice president.

She was born to non-citizen parents, holds Jamaican citizenship by birth, was educated in Canada, probably has dual citizenship with Us and India. Not something we want..

You are stupid if you let the Democrats implement a non constitutional action. They will keep doing it over and over and hope that you and America become “Sick of hearing it” until we all give in.

Trump? Let someone else should point on this, his press secretary, a women, would be a good person to start raising questions.

Maybe Canadian. Didn't K-Ho grow up in Canada? When 12 years old, the family moved to Montreal. She graduated from high school in Quebec.

Every American is entitled to his or her own definition of Natural Born Citizen since the Constitution is silent on that point. The problem comes when someone has to sort out all of the definitions floating around out there.

And, forget about the Federal Courts. They won’t touch this issue with a ten foot pole.

The following is from Chapter 2 of the Constitution of Jamaica,

A person born in Jamaica after August 5, 1962, or born outside Jamaica after that date to a parent who is a Jamaican citizen, is automatically considered a Jamaican citizen at birth. Furthermore, under current Jamaican legislation, citizens of Jamaica can hold multiple nationalities. And this status does not prohibit serving in the legislature of Jamaica. It is inconceivable to me that the intent of the framers of Article II would have been to allow such a thing for POTUS or VPOTUS.

Harris was born Oct. 20, 1964, and her father was a citizen of Jamaica at the time of her birth. Therefore, the law of Jamaica is clear: Kamala Harris is a citizen of Jamaica, pursuant to Section 3Cb of the Constitution of Jamaica. This law is very similar to the US Immigration and Naturalization Act with regard to children born to US citizens outsider of the boundaries of the US or it’s territories.

Wong Kim Ark was the subject of an 1898 SCOTUS ruling involving citizenship. The court held that Wong Kim Ark was a CITIZEN (not a natural born one) by virtue of the 14th amendment, noting that his Chinese citizen parents were lawfully resident within the US at the time of his birth, and completely self supporting.

The 14th amendment was ratified in 1868. It did not exist at the time that Article II was ratified in 1787. The 14th amendment does NOT refer to, or alter the meaning of Article II in ANY way, whatever one thinks that the framers meant for Article II to accomplish.

Harris’s birth status is identical to Wong Kim Ark. She was born in CA to two lawfully resident non citizen parents. She is NOT an Article II eligible Natural Born Citizen. She is a citizen at birth by virtue of the 14th amendment. I believe that Indian and Jamaican law make her a citizen of their countries too, as does US law under the Immigration and Naturalization Act which makes a person born to ANY US citizen ANYWHERE in the world a US citizen too.

Our overlords have decided that this is not an issue worth examining by adjudication. Constitutionalists know that the NBC requirement is designed to protect the office of POTUS from undue foreign influence, and it is worth observing, especially against an Anti-American opportunist like Harris.

In obama’s case it was presented that he obtained American citizenship by birth in America to Stanley Ann Dunham, his father being Kenyan

It was never settled that Stanley Ann Dunham a teenager was of age and citizenship duration to do so, based on further interpretation, nor that she was on American soil when she gave birth ( yeah yeah yeah we all saw the forged Hawaiian birth certs)

Kamel toe is completely off the range though since neither parent was American when she was born. Their later citizenship and thus hers was obtained by legal application...ie not “ naturally”

Why isn’t Trump eligible? Both parents were citizens at the time of his birth. His Mother was naturalized in 1942. He Isn’t an anchor baby like Harris. Both of her parents were not citizens when she was born.

Kamala Harris is not eligible to be Vice President.

12th Amendment: "But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States." [1]

Constitution A II,S I, C V: "No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President" [2]

Harris was born to foreign national parents who were both in the country, allegedly on student visas. Donald J. Harris was a Jamaican national [3] and Shyamala Gopalan was an Indian national [4]

Harris was born with Jamaican citizenship. She inherited her foreign fathers foreign citizenship by birthright, regardless of birth location. Jamaican Constitution, Chapter II [5] (a pdf)

The definition for "natural born Citizen" was from a source that is less known today, but was very well known and referenced often in the days of the founders and framers. [6] A source that was not only read from during the Constitutional Convention [7], but the principals from within were used as the legal authority to claim Independence from the crown of Britain in 1776. [8]. Born in country/territory, to citizen parents. [9].

A few months after President Washington was sworn into office, he checked out two books from the New York Society library. One of them was a copy of the very same legal treatise. [10].

The Congress tried to extend the definition to include those born outside the U.S., but again, to two citizen parents, with the Naturalization Act of 1790. [11] Two citizen parents where again key.

The definition was also read uncontested into the Congressional record, on 3 different occasions, by Congressman John Bingham - the father of the 14th Amendment on citizenship. [12]

That Harris is not eligible to be Vice President should be clear to any reasonable thinker and even "amateur" students of the real, recorded history.

Questioning Soebarkah's eligibility was turned into a spectacle of slander and charges of racism, by even most on "our" side. It will be interesting to see if that remains the case this time around.
Has President Trump instilled enough fight back into reasonable Americans that this question of eligibility will be brought to the forefront? Remains to be seen.

If we care about the Constitution, if we care about original intent, it's crystal clear that Kamala Harris is not eligible to be Vice President.
