I respectfully disagree. Just because there are some who would wipe their asses with our honored national documents, they are not practically, toilet paper. I think as a practical matter the Constitution is historical, but also it is a living document. That, in and of itself, prove it’s vitality, especially, in a time of governmental unrest. JMHO. It IS our ammunition against the anarchists.

The closest contemporary writing to the ratification of the Constitution on the subject of natural born citizens being of two citizen parents is Thomas Paine's 1791 book The Rights of Man, written just two years after ratification.

That statement is not even close to being correct.   See my post # 39.   There is a plethora of notes and writings contemporaneous with the drafting and approval process in the Constitutional Convention committees themselves.

The American University Law Review has this 2017 paper, “Natural Born Citizen”, that goes into great depth with sources cited from natural law through the ages up until that time.

It seems odd that you write of Jefferson and Paine regarding the U. S. Constitution when neither of them were present in the United States at the time it was drafted.

And I didn't mention Jefferson regarding the Constitution; I metntioned his personal letter to the Danbury Ministers which history has given the imprimatur of defining the "wall of separation between church and state."

You rightly mention that Jefferson was not part of the drafting of the Constitution, yet his letter years later is taken as interpretative. Why is that, because people liked what he said? Because he wt the Declaration of Independence ? Because he was President?

Paine wrote Common Sense and The American Crisis, the former six months before Jefferson wrote the Declaration. Paine spent the War in France securing foreign funding. So why isn't Paine's interpretation treated similarly? Because parties don't like it? Because he himself wasn't born here?

Why is Pence the only one with standing? I would think any American would have standing.

To prove standing you prove you were harmed. Just because your candidate lost doesn't qualify. But if Pence was beaten out of his office by someone who wasn't qualified then he may have a case. It would be a stretch but he's about the only one who would.

While it is true Trump’s mother was not born in the US, she became a naturalized citizen 4 years before his birth. Bottom line, Trump was born on US soil from two US citizens so he is a natural born citizen.

When Biden is declared unfit to hold office, there will be a cat fight between Harris and Pelosi. Pelosi will suddenly become a believer in the NBC (born on US soil from two US citizens) requirement to get herself sworn in as POTUS. Harris will suddenly realize obamy was no more a NBC as she is and ride to the office on his coattails.

Kamala doesn’t meet the natural born citizen of being born on US soil from two US citizens.

Ted Cruz is not eligible by any stretch of the imagination.

Guess who was on the committee to determine if John McCain was a US citizen. Hillary, Obama, Leahy, Caskill, Coburn and Webb and they brought in Homeland Security Dir. Chertoff for his read on it. Most interesting is those first two. Note Obama was never vetted.

Another interesting tidbit is you’d be hard pressed to see the original resolution presented to the Senate by the committee. Leahy had it on his site for years so I’m of the opinion he knew they’d given Barry a free pass.

Hit the send button too quickly. To follow, that committee and Chertoff defined NBC as born on US soil to two US citizens.

What they failed to note was McCain wasn’t born on US soil. Yes, his parents were on a US military base which is US soil but he was born off of the base in a city hospital. It doesn’t matter now since he wasn’t elected but what does matter is the committee did define NBC.
