Way too many questions about “leave of court”. Depending on the circumstances, it can actually mean “must” such as in this case.
All the liberals raising the possibility of the DOJ dismissing a case for the benefit of a politically connected person.
What about a defendant who is targeted only because they are a political enemy, such as what has happened with Flynn.
Why has no one brought this up?

US Acting Solicitor General Jeff Wall discusses the decision to dismiss the charges:
“The AG sees this in context of non-public information.”
“It may be possible that the AG had before him information that he was not able to share with the Court.”
Un-f'ing believable.

I agree. The Leftist Majority on the DC Circuit Court know the Supreme Court will override, but they accomplish the objective of keeping Flynn an unsettled issue until after Nov 3.

Wow, in Flynn hearing DOJ just said that Barr made his decision to move to dismiss the case based on BOTH public and private information before him (only publicly available info was disclosed in DOJ filings).
I may be wrong here, isn't there a process for an emergency USSC hearing?

The plea hearing was under Rudy Contreras who was since recused nullifying the plea. This process is beyond kangaroo court.
Yep, and for this female judge to say non-factual "evidence" can be considered by the Judge in the case ... un-f'ing believable.

There likely is a process, but would SCOTUS do it? If the DC Circuit were to rule in favor of Sullivan, then that would have major future implications for the DOJ. I believe SCOTUS would not want to do a ‘shoot from the hip’ emergency hearing.

I’m not so sure. After that last exchange, it sounds like she was leading him to make that last point that the request from the judge is not about getting the government to provide its case for dismissal, but to allow the judge from having a hearing on whether or not the executive branch’s position is reasonable, i.e. does the judicial branch have oversight over the executive in this matter.

It is my privilege to be the counsel for a group of distinguished amici curiae in General Flynn’s case...
Even as this whole thing unravels, the one element that really screwed Flynn is the guilty plea. And I know there were supposedly good reasons to do it, and there was bad legal advice at the beginning. But the bottom line, is when he agreed to cooperate with the Mueller team, he put himself in a really bad trick bag. He might still get out of it, but it will have to go all the way to the Supreme Court. This District Court is not interested in the law, it is only interested in the politics.
What is non-factual evidence?
I’m certainly willing to be wrong here, I’m not a lawyer.
