Judge Griffith echoes Sullivan’s argument in telling Flynn’s lawyer that the role of a judge - even when the government quits a case - is not merely “ministerial.”

The Left is betting on a losing hand.

You just cannot have judges send people to prison “just because”. The guy isn’t being prosecuted. There is no case. There is no controversy. But Sullivan wants to be a one-man Star Chamber and just send Flynn to prison.

This will get to the Supreme Court if it needs to, and they can’t possibly let it stand. It will rank up there with Dredd Scott as an embarrassing Supreme Court mistake.
