A Dallas attorney who said he is representing the man who shot Austin protester Garrett Foster July 25 claims the shooter was acting in self-defense.
In a written statement issued Friday, July 31, the law firm Broden & Mickelsen identified the shooter as Daniel Perry, an active duty US Army sergeant who was working as a rideshare driver at the time of the deadly shooting.

If someone points an AK-47 at you, has his finger on the trigger, either you get off the first well aimed shot or you are very likely to die. Sgt. Perry was well trained. Foster was an idiot.
He blames the training, Congress moves to alter military training.

Go watch the video online. Foster fired first, I believe about 4-5 shots. The noise from a Kalashnikov is distinctive. Very loud, low frequency.
Then you hear the other guy firing back, clearly a different gun, higher pitch, crisper.
Foster was crazed. You can see it in his eyes in the video interview he did a few minutes earlier. The SOB was looking to shoot someone. He missed. The other guy didn’t.
I don’t think that’s right. Foster never got off a shot - the 5 quick shots in succession were headed the other way. The next set of shots came from another peaceful Antifa protester as the sergeant drove away.

The commentary at the time was that Foster fired first.
He can face UCMJ charges as well as state charges. Depends on his commander or the pressure the Pentagon brings on the command. If Trump mentions anything favorable about the sergeant, Secretary Esper will likely go the opposite direction.

Criteria: "The Soldier's Medal is awarded to any person of the Armed Forces of the United States or of a friendly foreign nation who, while serving in any capacity with the Army of the United States, including Reserve Component soldiers not serving in a duty status at the time of the heroic act, distinguished himself or herself by heroism not involving conflict with an enemy."
Usually this is for saving someone from a burning car, drowning, etc.
