A federal judge in Washington has blocked federal executions scheduled for this week, citing concerns that the lethal injection protocol involved is "very likely to cause extreme pain and needless suffering."
Judge Tanya Chutkan said the last-minute ruling only hours before executions were set to resume for the first time in 17 years was "unfortunate," but she blamed the Justice Department for racing ahead before legal challenges had been fully aired.
The judge said the prison's plan to use a single drug, pentobarbital, could cause pulmonary edema, producing a sense that the condemned men were drowning. That would violate the ban on cruel and unusual punishment, she said. The federal government has appealed her ruling.
The decision came amid a wave of litigation involving family members of victims and religious advisers to the men on federal death row.
Lee, 47, had been sentenced to death after the brutal 1996 killings of three people in a robbery to finance a white supremacist cause. Relatives of his victims had petitioned a court to delay the execution, citing the difficulty of traveling to the federal death chamber in Terre Haute, Ind., during the coronavirus pandemic.
A lower court judge agreed, but the U.S. Court of Appeals for the 7th Circuit overruled the district judge and paved the way for the lethal injection process to proceed.
The appeals court panel said family members of his victims do not have a statutory right to attend the execution. The court wrote their claim "lacks any arguable legal basis and is therefore frivolous."

Obama Judge. I knew by the first name Tanya. She made no mention of the victims of these pieces of $hit. The first guy tortured a family of three before killing them, and dumping them in a lake. But we sure have to worry about hurting him before he kicks the bucket. Having spent a career in the prison system, I have no sympathy for any of these f’ers.
If I remember correctly, and I’m too lazy to look it up, the girl he murdered was 8 years old. I don’t want this evil thug tortured to death, I just want him gone from our world. The sooner, the better.
This so-called judge is an Obama appointee, of course, and she disgusts me. What kind of evil person sides with thugs who torture and kill children? [I know, I already answered that. An Obama follower does that.]
Or a firing squad, instant death, no pain, no muss, no fuss.
The only reason everyone hasn't gone this route is to keep the controversy surrounding executions stirred up. Nitrogen is cheap, effective, and painless.
That machine was featured in the movie No Country for Old Men IIRC and the killer was the subject of nightmares.
CO2 triggers a suffocation response when your CO2 levels in your bloodstream rise. Nitrogen doesn't do that. If you were to walk into a room that was 100% nitrogen, you would be completely unaware that anything was wrong until you woke up facing either satan or Saint Peter.
I don’t really care how they put him to death, whether he’s tortured or not, because he didn’t give the same consideration to his victims, and he’s been allowed to remain alive far longer than he should have.
