A federal appeals court decided 2-1 Friday that the Trump administration violated the law when it used military funds to build a wall on the Mexican border.
The U.S. 9th Circuit Court of Appeals said the power of the purse belongs to Congress, and the administration lacked constitutional authority to transfer the military money. Two Democratic appointees were in the majority. A Trump appointee dissented.

The USSC cannot be fixed without returning the beginning before the USSC asserted its primacy and that assertion became accepted by the whole nation. The Court having the last word is not a tenet of the Constitution but there is no opposing it. Appointed judges cannot be checked should they decide to make totally insane patently unConstitutional Decisions. Solid Conservatives become liberals almost predictably- pace Clarence Thomas- once on the Court and understanding that they have The Power. We need an Article V convention but that won’t happen either unless there is a massive backlash against the current insanity.

And speaking of power, the corrupt 9th Circuit Court wrongly ignores that citizen taxpayers have not only always had the express constitutional power to elect federal representatives, now also to elect senators, and effectively ordered Congress to build the wall when they elected PDJT.

a somewhat quicker way to solve the court’s problem is for an administration (as a co-equal branch of government) to simply ignore a court order.
the specific item should be carefully selected, probably one where the court has interfered with the president’s national defense duties? or some clear violation of citizens’ constitutional rights

So the military cannot be used to defend the border? Building a wall is a humane thing to do. I’m all for setting up machine guns on sensors to cut any illegal in half as they trying to invade. It would only take a couple of casualties and the invasion would stop. Far fewer wetbacks would die that way than they currently do at the hands of coyotes and nature.
9th Circuit has no jurisdiction in this case. If Congress doesn’t like it, it is up to them to dispute the constitutionality.
Next is probably 9th circuit “en banc” (all together).
