It's kind of incredulous radical court activism really, but look at the Judge's backgrounds and you can see how it happened.
The best part may be the penultimate graf in this report where Sineneng-Smith's SCOTUS counsel whined about his rare 9-0 slapdown like a stuck pig.
They (the 9th) are lazy (they meet in these cool old Courthouses and then go back to their manses and condos and have their clerks do the work) and they paper over their laziness by polishing-the-turd, which is the 9th's rep as the 'de novo' Marxist incubator.

Perhaps this is Ginsburg’s last “gasp” at showing any signs of judicial sanity. Otherwise, tomorrow it will be back to far-leftist pseudo-judicial writings and rantings.
Time for her to go. Where, I don’t care. However, I heard a rumor from Harry Reid’s Romney source that the Devil put out a “Not Welcome RBG” sign at the front gates of Hell, while God said “Ruth, since you don’t believe in me, you can’t believe in my home, Heaven. I think it shows that RBG has limited time and is looking for forgiveness for the horrendous life she led.

I can’t agree with that. John Nash came to some correct conclusions, but suffered from an extreme case of schizophrenia. OTOH, there are large numbers of stupid but sane people who hardly ever get any of the big questions right.

One would expect higher intelligence to produce more depth of understanding, but even that is subject to considerations of the type of intelligence.
