U.S. Attorney General William Barr on Monday released a memo to federal prosecutors which sought to balance public safety measures with the preservation of constitutional rights and civil liberties during the coronavirus pandemic. The memo instructs U.S. Attorneys to be on the lookout for orders by state and local governments which encroach upon the rights of citizens.
Barr said he is expanding the mandate on prosecutors previously directed to prioritize cases against persons accused of illegally profiting from PPE hoarding and price gouging to also encompass constitutional violations.
Now, I am directing each of our United States Attorneys to also be on the lookout for state and local directives that could be violating the constitutional rights and civil liberties of individual citizens, Barr wrote.
Per the memo:
As the Department of Justice explained recently in guidance to states and localities taking steps to battle the pandemic, even in times of emergency, when reasonable and temporary restrictions are placed on rights, the First Amendment and federal statutory law prohibit discrimination against religious institutions and religious believers. The legal restrictions on state and local authority are not limited to discrimination against religious institutions and religious believers.
Barr said he is authorizing the Assistant Attorney General for Civil Rights Eric Dreiband and the U.S. Attorney for the Eastern District of Michigan Matthew Schneider to coordinate DOJs efforts to monitor state and local policies and, if necessary, take action to correct them.
Barr also provided an example of the conduct the DOJ should be ensuring does not take place.

Me too but it will take ^individual citizens^ to force the point.
The FBI will not take it up on its own.
Involuntary regulated entities, businesses, have no standing.
That is what Barr is signaling.
Only citizens are harmed by over-reach.
That said, I remain vigilant for my civil rights and my normal routine is not disrupted. As noted prior, I have the District FBI in my contacts (just happens to be the FDA mentioned in Barr’s Orders)

The conundrum here is that every order issued at the state and local level during this emergency would be unconstitutional during normal times.
Every single one.
Yet there is a wealth of precedent for such restriction of liberty through our history, even reaching back to English common law.
This begs the question: Is Barr going to prosecute every one of these jurisdictions? Or, is he going to allow a continuous gray to dominate black and white law?
Hell, that’s no law at all. That’s the rule of man.
We could see a McDonalds free to open in one town, yet DOJ looking the other way when a home hairdresser is jailed in another.
Our Founding Fathers designed check and balances. They designed an INEFFICIENT GOVERNEMENT.
Our government is way to efficient and many here want it to be efficient.
Words have meaning. look them up. Do we want an effective and efficient government? Maybe yes, maybe no?
They won’t have a problem with it because state and local governments beggars cup will be full they are milking the system for all it’s worth.
