Judge Rules Illinois Governor Exceeded Authority, Violated Civil Rights with Coronavirus Stay-at-Home Order

Via The Washington Times:

A judge in southern Illinois ruled Monday that Gov. J.B. Pritzker’s stay-at-home order to stem the spread of the coronavirus exceeds his emergency authority and violates individual civil rights.

Pritzker promised “swift” action to overturn the judge’s order, which applies only to Bailey but allows other individuals and groups to challenge the movement restrictions while the highly contagious illness circulates.

The ruling came the same day House Republicans attacked Pritzker on another front, renewing demands for details on state prison inmates released early because of COVID-19 fears.

Pritzker signed an order earlier this month allowing furloughs for elderly inmates or those with health conditions, who are considered “medically vulnerable” to contracting and spreading COVID-19. Roughly 36,000 people are incarcerated in Illinois facilities and civil rights advocates have raised concerns about inmate welfare. “It’s insulting. It’s dangerous and people’s safety and health have now been put at risk,” Pritzker said. “There may be people who contract coronavirus as a result of what Darren Bailey has done.”

The judge blasted Pritzker’s stay-at-home order for violating the Constitution and shredding the Bill of Rights

“How in the world does me not being allowed to fish the lake promote COVID-19 but panic-buying at Wal-Mart doesn’t?” Judge

Where’s the nationwide injunction?

Guess only the left gets those.

Pritzker promised “swift” action to overturn the judge’s order

How's he gonna do that?

Get the his pals on the corrupt Illinois Supreme Court to overturn it? That'll look worse, and it'll only get appealed to the USSC anyway.

Judge was right, this is unconstitutional, idiotic, and will not survive.

My first thought also.

There are rules for them, and there are rules for us. The sooner the hoi polloi learn that, the better off we will be.

The nerve of the great unwashed talking back!

He’s pretty good with the “Stay at home order” judging by his weight.

Fatzker may even win in court, but this is all playing very poorly in downstate Illinois. Cracks are appearing in Madigan’s fortress.

Speaking of Madigan, he’s been very quiet of late. Wonder if he’s back from Florida yet...

And the federal government clearly has no intention of defending the US Constitution and Bill of Rights from the ongoing, ever-expanding tyranny of the governors, the county commissioners l, the mayors and the vast array of other state-level tyrants.

I wonder if Trump will reprimand this judge? This ruling could jeopardize Birx’s precious opening phases.

Trump hasn’t ordered a lockdown. The individual states did.

“Where’s the nationwide injunction?”

No such thing. Each state will have to determine in their courts, en-route to the supreme court. if they’ll hear it, for each individual state determination based upon persuasive authority.

And the judge did not give a decision based upon the state but for the individual, Darren Bailey. It is the first step toward a possible shutting down some or all of the shelter in place state EO’s, but at this point, it has nothing to do with the state until that battle is fought. Then it gets down to who wants to bring down the hammer in each state.

.....

The States are doing this under the guidance of the Federal Government, specifically Fauci and Birx’s recommendations!

But, like I said, Trump, nor any other federal agency ordered it.
