An 18-year-old Wisconsin high school student was arrested Thursday for fourth-degree sexual assault, child enticement, and exposing his genitals to a child in the schools gender-neutral bathroom.
According to WSAW-TV, the Oneida County Sheriffs Office said Austin Sauer of Rhinelander High School in Wisconsin was arrested, but has not been charged. The sex of the child was not reported.

In a gender neutral bathroom, there is no crime for exhibiting genitals.

If you go do your business and then zip up, there's no crime (other than having the stupid gender-neutral bathrooms in the first place.) It doesn't sound like that is what happened.
I'm not sure what "4th degree sexual assault" is. It could be that they went willingly together and they were 18 and 15 years old.

I can see this. In some states, and I can’t find it in Wisconsin law, if you charge someone with a crime at a certain level, like first or second degree, the court process doesn’t allow discovery with the ability to change the charge during the process. So the perp would walk out of the court house until another arrest warrant could be set up to match a proven offense.
The length of time it takes to get a warrant can vary a great deal depending on the jurisdiction, the severity of the offense and the priority given to the matter by the DA, etc. An arrest warrant might take as little as one or two business days (very rare) or as long as a few months. But by then, he could be anywhere.
I think they are just getting their ducks in line as sexual assault in that state is really defined.

Despite all the comments blaming the bathroom policy, I’m guessing if not there it would’ve happened somewhere else, like the traditional behind-the-gym or car. A horny teen is a horny teen, everything else is incidental.
