An illegal immigrant accused of raping a 13-year-old girl in Brooklyn was cut loose thanks to New Yorks sanctuary city policy and the Brooklyn District Attorney despite a request by immigration officials that he be detained.
Guatemalan national Miguel Federico Ajqui-Ajtzalam, 20, was arraigned Friday on a 20-count criminal complaint for allegedly raping the girl five times in 2018.
But Brooklyn DA Eric Gonzalezs office didnt ask the judge to set bail, and Criminal Court Judge Hilary Gingold agreed to let him go on supervised release.
Immigration and Customs Enforcement had issued a detainer asking the city to nevertheless keep Ajqui-Ajtzalam in custody because he is in the country illegally, but said the Big Apple did not comply due to its sanctuary city status.
ICE finally tracked Ajqui-Ajtzalam down Monday and took him into federal custody, but issued a furious rebuke of the city.
Its inconceivable that an individual who was arrested on local charges of rape and sexual abuse of a child would be released back into the community, Thomas Decker, ICE removal operations director in New York, said in a statement Tuesday.
Its frightening that our detainer was ignored and he was released on to New York city streets to possibly re-offend.

My nephew is an ADA in Brooklyn and he says there’s virtually NO CHANCE of getting time if you are caught with a gun and have a clean record.
You will not be held and you will get probation.

What is really sad is that this illegal alien rapist will not face charges in New York because ice cannot trust giving the illegal alien back to the state of New York to face charges. Unless this illegal alien rapist faces federal rape charges his reward is a free trip to his home country and no prison time.

This mirrors what DumblASSio did with the NYC schools first. Little by little, he eliminated types of offenses which could be disciplined by teachers until there is virtually nothing a kid can do--particularly a kid "of color"--which will lead to disciplinary measures. They didn't want schools with high levels of problems to "look bad" so that parents wouldn't want their kids to attend that school. In order to get a kid suspended, teachers have to jump through so many hoops that it just isn't worth their time. The schools chancellor Carranza is ONLY interested in "equality" and "diversity" and cannot be bothered with schools totally run by the students therein, no holds barred.
This insane situation with "you can't hold a criminal nor charge them bail" is just that school policy writ larger, with far more tragic consequences. It is dangerous to live in NYC, and in NYS now because the politicians in charge are just plain nuts. They see NOTHING but their commie agenda and the means to enact it, public safety and welfare be damned.
This stuff makes me furious. The politicians that let this guy out are traitors to the American people.
Armed ICE agents should be posted in NY Courts (and other sanctuary states/cities) en mass. Barge in a grab as needed.

I don't know the nephew or his uncle, but I'd surmise it's to do as much good on earth as he can, even if the way is hard. I think jobs like his are good ones to ponder in Lent.

You can bet your rear end that if say, a Caucasian tourist from Idaho was caught with a gun in his vehicle in NYC. Felony, held with $1 million in bail, and charged to the full extent of the law.
