New York lawsuit calls Trump admin Global Entry ban "unconstitutional"

New York filed a lawsuit against the Trump administration Monday, calling a Department of Homeland Security move to ban New Yorkers from enrolling in Global Entry and other Trusted Traveler Programs "unlawful," "unlawful" and "discriminatory."

Driving the news: Acting Homeland Security Secretary Chad Wolf told Fox News last Thursday that the department was blocking New Yorkers from the programs in response to the state passing the "Green Light Law," preventing federal immigration officials from accessing vehicle records without a court order.

The lawsuit calls the ban "political retribution" for New York's law allowing people without legal immigration status to obtain driver's licenses in the state.

LMAO! I posted the story of Trump banning New York residents from Global Entry and TSA preCheck because NYS refuses to allow DHS to access the database.

Just IMAGINE all of the rich and powerful New Yorkers now having to stand in the TSA lines at LaGuardia with the Great Unwashed for hours, waiting to be groped, then calling their State and Local Pols complaining about it.

Fedgov is responsible for travel and immigration.

The states are sure as hell clearly not in charge of it.

I would cut off as much federal funding as possible to all sanctuary cities, immediately.

They won’t be that rich or powerful if they’re standing in line at LaGuardia - private jet passengers are filtered in a separate facility.

I can see their point. The ban clearly offends Section 3 demands for unimpeded air travel and passage for citizens of each state. It’s clearly written in “plane” English, in the Constitution, before air travel was invented, because the founders were genius futurists.

That’s just it, it doesn’t impede thier travel, they just have to stand in the long lines with the rest of the Prols.

I assure you, NYS legislators are getting calls from people like bank CEO’s asking about this.

Just imagine the look on the face of the staffer who stumbled onto this idea. Probably the same look that Eric Ciamarella had on his face when he got the idea to try to get Trump impeached with a whistleblower complaint based his retelling of secondhand inaccurate information.

Obviously NY has NO legal issues which need the attention of the laughable affirmative action idiot they have as Attorney General, Letitia James, so she has time for ridiculous nonsense like this. Trump has every right to control who comes in and who goes, and how. He ALSO has the right to access the DHS database. It’s part of protecting our country against hostile invaders, one of his sworn duties. It’s a shame the a@@clowns of every single level of NY government, from the governor to the mayor of NYC, are actively working to destroy the sovereignty of our country, but there you are. They are enemies of the state, sure as shootin’.

Which will not stop some Obama-appointed judge from issuing an injunction prohibiting the federal government from enforcing the ban until it winds its way through the courts over the years.

I think DHS should prohibit anybody from getting on a commercial flight with a NY driver’s license. They are not a score form of ID anymore.

Its not about political retribution. NY doesn’t get to pick and choose which federal laws it will enforce.

What’s been established is the federal government can condition state participation in federal programs or benefits on state compliance with those federal programs of benefits.

NY is free not to participate in them if it wants. But it has no business telling the federal government it won’t comply with them if it chooses to participate in them.

Thus, its lawsuit is wholly without merit.

Until... that is... some federal judge living in NY can't avail his/herself of the convenience of TSA Pre-check & Global Entry the way he/she used to.

I’m curious what happens to NY’s Real ID program? Even as a resident I am unclear if all licenses will be Real ID compliant by the end of the year? I had to pay more money and produce more proof of ID for Real ID in NYS than I needed for a passport.

A simple google search on anyone following this story would see the fed had every right to take this action. In fact, there is still a lawsuit against the state DMV pending by DEMOCRAT NY County Clerks making exact same accusation.

This was in the news in upstate NY as late as last month.

This action may have been taken based on the complaints from County Clerks. The one using this as a political weapon would be the Governor, Mr. Cuomo; calling Trump among other things, and “arrogant thug”.

The County Clerks also complained about a rush to implement this so-called “Green Light Law” that hands out licenses to illegals. Why the rush, you ask? Well, look at the season, and remember the fact that the NY State government doesn’t rush anything except tax increases and gun laws. Heck, for a state that wants people driving less, why be in a rush to hand out new licenses based on information that cant’ be verified?

Bottom line: This act by NY state to pad the voter rolls, as of course, in NY, you can immediate register to vote once you obtain as license. The federal government has the right and responsibility to put a stop to it.

TSA precheck was not affected by this policy. NY residents can still apply for that.
