Democrats are increasingly looking to get Chief Justice John Roberts involved in the debate over witnesses in the impeachment trial as Republicans claim they have the votes to block testimony from former national security adviser John Bolton and others.
Sen. Chris Van Hollen, D-Md., has said he plans to introduce a motion on Friday that would call for Roberts to rule on subpoenas for witnesses, documents, and questions on executive privilege around the additional information Democrats want to bring into the impeachment trial.
No Republican can question the fairness of this approach- the Chief Justice oversees the highest court in our land and was nominated by a Republican President. And, given his authority to rule on questions of privilege, they should not fear a drawn-out process, Van Hollen wrote in a statement posted on Twitter.
I urge my colleagues to seek out the truth and the facts and to vote in support of my motion. Anything else constitutes an effort to hide the truth, he said.

Roberts has little say in the matter. If McConnell had said the Senate was not going to vote on the issue of additional witnesses (or anything else), Roberts might have interjected that the Senate as a whole has to vote on each and every issue. Other than that, he can’t force how the trial is conducted by the Senate.
The constitution says the senate sets its own rules.
This guy was on Moaning Joe this morning. He knows it will end today. He appeared to be deeply saddened.
A majority can overule the Chair.

yes they can because The senate makes the rules and the SC judge presiding over this senate procedure, has no authority to change that.
I still wonder how the Rats got Roberts to rule in their favor on Obamacare...
If Roberts has any intelligence at all he would not consider stepping in that.

Which begs the question: Why did the democrats impeach Trump without the truth and the facts? Isn’t that a coup conspiracy?
They sure do want Roberts involved in decision making. Which makes me immediately suspicious.

Roberts should stay out of it, especially if there is a tie cause with a tie, they should lose.
I mean, Orange Man must be really bad for liberals to want to open the door to the precedent to a judge calling witnesses for the prosecution. That’d sure change a number of trials for the liberals potential voters.
I agree with this. The problem is, I have yet to see the actual rule adopted by THIS senate saying that a tie fails.
In 1867, CJ Chase did break ties, so there is precedent. In Clinton’s impeachment, they (naturally) ruled that the Republican-appointed Rehnquist could not break ties.
Chad Pergram on Twit has said that’s the case here-—but it’s NOT clear he is citing THIS senate’s rule, and so far, I’m not sure anyone knows what THIS senate’s tiebreaking ruling was.
