GOP senators introduce resolution to change rules, dismiss impeachment without articles

Roughly a dozen GOP senators want to change the Senate’s rules and allow for lawmakers to dismiss articles of impeachment against President Trump before the House sends them over.

Sen. Josh Hawley (R-Mo.) introduced the resolution on Monday, arguing the Senate's impeachment rules do not envision a scenario where the House would delay transmitting articles against a president, as Speaker Nancy Pelosi (D-Calif.) has done.

"The Constitution gives the Senate sole power to adjudicate articles of impeachment, not the House. If Speaker Pelosi is afraid to try her case, the articles should be dismissed for failure to prosecute and Congress should get back to doing the people’s business," Hawley said in a statement.

The resolution would give the House 25 days to send articles of impeachment over to the Senate. After that, a senator could offer a motion to dismiss "with prejudice for failure by the House of Representatives to prosecute such articles" with a simple majority vote, according to Hawley's proposal.

The resolution comes as some Senate Republicans have mulled changing the chamber's rules to allow them to dismiss the impeachment charges against Trump, even though the articles have not been sent over from the House.

Hawley's resolution has support from GOP Sens. Rick Scott (Fla.), Mike Braun (Ind.), Marsha Blackburn (Tenn.), Ted Cruz (Texas), Steve Daines (Mont.), John Barrasso (Wyo.), Tom Cotton (Ark.), Joni Ernst (Iowa), David Perdue (Ga.) and James Inhofe (Okla.).

"Speaker Pelosi and House Democrats have made a mockery of our Constitution and abused impeachment for political gain. Now, they’re undermining the role of the Senate by attempting to dictate the terms of the Senate’s trial," Cruz said in a statement.

The Senate has the sole power to try all impeachments. The House has no role over there.

Nancy has no business telling the Turtle what he can and can’t do.

All we hear from Nancy are excuses. Democrats want the Senate to do a do over for them.

Republicans aren’t interested.

Nothing in the constitution says they have to be delivered. When the vote was taken and put in the Congressional record, that is it. It’s done...Finished...DONE.
Mitch should simply start proceedings and take a vote dismissing them.

I don’t think there is a prescribed way for an impeachment to be delivered to the Senate. The fact that the House has voted for impeachment isn’t exactly a secret; the Senate can take their copy of the Congressional Record for that day to be that delivery.

They are trying to hard. The resolution should be to dismiss the charges with prejudice. McConnel could bring that up for an up or down vote.

It is no less Constitutional than what the House has Done.

Anybody know the History of the Filibuster? It’s not in the Constitution. It’s a “Senate Rule”. But at one time, it was a powerful tool. But it had a process by witch debate (talking) went on forever, which never allowed for a vote. The Senate got lazy and decided that was too much work. Instead, they could just say they needed 60 votes for Cloture (stop debating and vote).

Well, impeachment is now in the same territory. The Dems have shammed a ridiculous case together under the guise of impeachment without any substance or process judicial respected. In the future, the House can just vote to impeach with some “reasons”. And the Senate can agree or disagree with a 2/3 majority vote to convict and remove from office. The same way the Filibuster turned into a mockery partisan tool.

Why give them 25 days? These people still don’t know they are in a war. If they are giving 25 days count the days that have already passed since the vote.

Until it hurts them politically, nothing. The only way it hurts them politically is if their allies in the media turn on them. The dems will do and say anything as long as the press supports them. BECAUSE it is the press that is feeding them the pole numbers, which the same media use as a measure of how successful they are influencing public opinion. Polls today are the scoreboard the media uses to see how they are doing pushing their agenda. They hammer the public with bias and BS and fake news, then check to see if they have moved the polls with their reporting.

If its dismissed with prejudice, Democrats would have to find new grounds for impeachment.

That would take time and I don’t think they have in them to build a bipartisan case for one.

They’re lazy and think all their political problems would be solved by waving a magic wand.

Then again, Democrats are like the Bourbons: they forget everything and they learn nothing.

I’m kind of sad they are considering this. A couple of the main reasons Pelosi is sitting on this is because they will uncover themselves and get themselves into investigations on them because all the charges of impeachment only hold weight due to their prior graft. I don’t want them to get off so easy. They accomplished their goal if it is cancelled as they only thing they were trying to do was dirty the water for the 2020 and scare voters like with Thomas, Bumatay, and Roberts. If the real truth comes out, a whole lot of Desi’s will have some “spaining” to do. Do’t let them get out of cutting their own throats.
