As we suspected, albeit against much criticism, House counsel Doug Letter has responded to the DC Appeals Court arguing the forced testimony of White House counsel Don McGahn is needed for evidence in impeachment trial. [Court pdf Avail Here]
This court filing today bolsters the unspoken background motive for delayed House Impeachment Managers. The House Judiciary Committee is using impeachment as support for their ongoing effort to gain: Don McGahn deposition, and Mueller grand jury material (6e). The goal is opposition research; impeachment is a tool to establish legal standing to obtain it. Everything else is chaff and countermeasures.

Everything they do is calculated and schemed to the T. People keep saying Nancy is stupid, doesn’t know what she is doing. I think the opposite. I think they know Graham is all talk and no one will subpoenaed due to block by Feinstein. I think they know how McConnell will play this out. I think we Republicans are going to get played by our Senators. Too many people are at risk if testimonies are allowed to happen.
There is a hearing with three Judges regarding McCahn testimony. They have not handed over the impeachment for devious reasons. They are plotting,planning, getting the Judges in line to hear the case. I bet they have already talked to the Judges or at least two and know how they will vote.
I really fear McChan and I think he could do some damage. He was way to eager to want to testify. Why? President has had so many people who have stabbed him in the back that was in his cabinet, lawyers, etc. I think McChan will lie, set up the President just like the Ambassadors and State dept folks did in their testimonies.
I also suspect they already know via lawfare what is in Grand Jury testimony. If they don’t get access to it by the courts, it will some how get leaked just before elections. October surprise.

I read their court argument. They need McCahn’s testimony, they tell how he wants to testify but can’t due to legal laws currently. They say how it’s important for this case because they want to ensure that the DOJ and FBI will not be acting with any political bias with current and upcoming criminal investigations, etc.
Court date is January 3rd folks. Three Judges will hear the arguments, 15min each.
I suspect they have paid the Judges by now and know how they will vote.
McGahn was long gone before Congress voted for the aid!
From the Democrat POV: why not? The do-nothing doormmat GOP Senate is green lighting this nonsense with their inaction. It’s now been over 3 months since the CIA coupist launched his treasonous assault. And what we gotten from the GOP Senate? Exactly Nothing.
Even if Trump asked McGahn to fire Mueller it was within Trump’s right to do so and Mueller was not fired so how could they claim obstruction? I am getting angry about the lack of actual movement by Mitch here. A lot of noise but no action. I don’t trust Mitch as far as I can throw my car.

Some believe impeachment was essential for the courts to allow Democrats to have Mueller’s Grand Jury material. Thus, the reason for the impeachment vote last week. Andrew Weissmann likely already shared copies of the GJ stuff with fellow corrupt Dims, so they know what’s in it, but need legal authority to use against Trump. I guess we’ll see now.
