Ginsburg health scare raises prospect of election year Supreme Court battle
The Hill ^ | 11/30/19 | AlEXANDER BOLTON

The recent hospitalization of Justice Ruth Bader Ginsburg following a year of health scares has raised the prospect of a Supreme Court vacancy in an election year and a partisan battle royal that would likely surpass the impeachment fight.

Liberal activists are already calling on President Trump to keep any possible Supreme Court vacancy open until after the 2020 election, but Senate Majority Leader Mitch McConnell (R-Ky.) has indicated he would fill a court vacancy next year, even though he blocked former President Obama’s nominee for most of 2016 after the death of Justice Antonin Scalia.

...

“If we had a Supreme Court vacancy this year that Trump attempted to fill, it would be in the middle of an election year but not just any election year. It’s going to be a year in which Trump is likely to have been defending claims against abuse of power and obstruction of justice in an impeachment trial,” said Marge Baker, executive vice president of People for the American Way, a progressive advocacy group.

...

Liberal activists think they would have a shot at derailing a potential Trump nominee next year, as Senate Republicans will have to defend 22 seats, including seats that Democrats have a good shot of picking up, particularly in Arizona, Colorado, Maine and North Carolina.

After watching vulnerable Democratic incumbents such as former Sens. Claire McCaskill (D-Mo.) and Joe Donnelly (D-Ind.) lose in 2018 — losses they both attributed to the messy partisan fight over Kavanaugh — vulnerable GOP senators may be reluctant to support a controversial Trump pick.

They have no idea who Trump will nominate. They only know it will be controversial, and the person picked will, of course, be guilty of multiple crimes against women.

Kim Clement’s prophecy if true was that two would step down during Trump’s Presidency.

Scalia didn’t step down. He died. And before Trump took office.
Kennedy stepped down.
If Ginsburg dies, rather than steps down, that may not count.
Meaning Trump could replace her and one more that steps down during his two terms.

No battle about it.

What will the Dems cave on is more like it. Cave on nothing and keep playing these stunts, and the new supreme judge goes in.

I live in Maine. The democrats have no chance of picking up a Senate seat here against Collins.

They’ll try, because of Collins’ support for Kavanaugh, but they will fail.

Trump could produce a good deflation of liberal apolexia by refusing to nominate a Ginsburg replacement until after the coming election.

What he’ll probably do upon Ginsburg’s retirement or passing is to name prospective names at high frequency but actually nominate nobody. Just for the excitement factor, LOL.

I refuse to get on that panic express, since Justice Thomas is only a bit older than me-and most of my neighbors-we work at the businesses we own, sometimes long hours, some work as sheriff’s deputies-long hours, again-we are healthy, hard working country people, and Justice Thomas looks and acts healthy, sharp and able to handle the long hours-in his interviews, he is absolutely on fire-he’s not going into any goodnight now, nor should he...

RBG on the other hand has a form of cancer that is mostly fatal at any age-the only unknown is how long her remission(s) will be-I say replace her if she does not survive 2020-let the democrats howl and throw tantrums till Satan goes ice skating on the WH lawn-they can’t be allowed to have control of the courts any more, no matter what that takes...

She’s not going to step down as long as she’s alive.

As much as liberals love RBG, many are still angry with her for not stepping down in 2014 when Obama and a Democrat Senate could've picked her replacement.

McConnell would have blocked her replacement too.

According to the "National Vital Statistics Reports" the gap in life-expectancy narrows, as age increases. There's only about one year's difference between the life expectancy of 71 yr. old white and black males. Based on average statistics, Justice Thomas can expect to live for about 12 more years. Given his occupation, the first-class health care he receives, and what's known about his current health; it's likely that he'll live significantly longer than the average.

Check out the tables at the link below (Table 21, starting at page 53) https://www.cdc.gov/nchs/data/nvsr/nvsr68/nvsr68_04-508.pdf

Cruz would be a good campaigner. More drama. That’s what we need. Perhaps the rat senators would be happy to kick him upstairs.
