A new lawsuit is challenging a California law that requires corporations to elect a minimum number of women to their boards of directors.
On Wednesday, the Pacific Legal Foundation (PLF) sued California Secretary of State Alex Padilla, the state official in charge of administering SB 826. That law, passed in 2018, requires that, by 2020, all publicly traded companies headquartered or incorporated in California have at least one woman on their board of directors.
Come 2022, companies with five-member boards will need to have at least two female directors. Firms with six or more directors will need at least three women on their board.
Failing to fulfill the law's gender quota or to properly report the composition of their boards to the state can net companies fines of $100,000 for the first violation, and $300,000 for each subsequent violation. Each board position required to be occupied by a woman, but isn't, counts as a separate violation.
The purpose of the law, according to its sponsor, state Sen. Hannah-Beth Jackson (D-Santa Barbara), is to make the top of the corporate ladder more equal and to improve corporate decision making.
...
The potential constitutional flaws of SB 826 are not news to anyone. Even supporters of the bill have acknowledged that it might not withstand legal challenge.
"There have been numerous objections to this bill, and serious legal concerns have been raised," wrote then-Gov. Jerry Brown in a statement after signing the bill into law. "I don't minimize the potential flaws that indeed may prove fatal to its ultimate implementation."

“All right. Two of youse gotta wear the wig and high heels tonight.”
That’s good. They should be sued about this artificial requirement. This is part of the reason many european countries are now screwed up with laws demanding a certain appearance. Never mind demanding a certain level of competence. Countries such as Norway, Sweden and Denmark.
I still think of that photo from Sweden, showing a dozen men on a social committee, all of them wearing pink pussyhats.
“Liberty? What’s that?”
Well wait a minute, I thought gender didn’t matter anymore and it could be whatever someone says it is?
The libs better make up their mind.
Simple. The board simply needs to draw straws to determine which ones will identify as women.
Done!
“You can be on our Board, but you’re going to have to identify as a woman”.
Because ruining women’s sports hasn’t been enough.
Simple. Just tell the gov't that a couple of your board members identify as female.
They wouldn't dare question it.
What a great idea! High taxes on individuals are forcing labor to leave because they can’t afford housing and now the State wants to make sure their employers leave, too, by taking away their right to manage as they see fit. Brilliant move, Stupid.
What does it say about a legislature that knowingly passes an unconstitutional law?
No problem. Just say all the male board members “identify” as women.
Problem solved.
The entire nonsense of racial diversity ONLY applies here.
In Japan EVERYONE is Japanese = no racial diversity.
In China EVERYONE is Chinese = no racial diversity.
In India EVERYONE is Caucasian = no racial diversity.
In the sub-Saharan countries EVERYONE is black = no racial diversity.
Who were the morons that decided that quotas should fill RACIAL quotas? What about REAL diversity ... of thought and ideas?
Yes, I know, there are exceptions to "EVERYONE."
Good
The crux of the problem is that most men want to watch MEN playing sports. They don't care to watch women because women simply don't have the strength to achieve those athletic goals that men can.
Besides, women don't play football or baseball.
And, women don't want to watch other women play sports. I know that I didn't/don't want to.
There are a few women tennis players that I watched.
I watched the Williams sisters because I detested them and wanted to see Serena start losing. I ended up liking Venus because she finally GREW up and was nice.
And, poor Serena, she's losing...and even her white husband Alexis Ohanian [from Google: Alexis Kerry Ohanian, also known by the username kn0thing, is an American Internet entrepreneur and investor. He is best known as the co-founder and executive chairman of the social news website Reddit.] can't make Serena 25 years old again.
So it gave me great satisfaction to see that big, nasty, old cow LOSE.
But watch women's golf? YAWN.
I do play golf...or a reasonable facsimile thereof. My husband was the golfer.
Wh would do business in California anyway?
Not only do they identify as women, but identify as black Hispanic physically challenged women.
