Under what circumstance is a person born in the US and a holder of a US passport (albeit burned) not a US citizen? Not that I give a rat’s patootie about her fate, of course...
She was born to a sitting Yemeni diplomat. See the constitution. Not a citizen.
“She was born to a Yemeni diplomat in 1994 and was issued an American passport despite eventual confusion about when her father’s diplomatic post officially came to an end.”
She is the daughter of a Yemeni diplomat, and is not considered a US citizen because of being a child of a diplomat. She was given a US passport in error in the first place.
When that person swears allegiance to a foreign power.
As I understand it, her dad was a diplomat. Their children do not get birthright citizenship. There was a question about the timing of her birth and her dad’s leaving his assignment which led to her incorrectly getting a US passport.
Children of diplomats or soldiers of other nations do not get birthright citizenship. It’s been that way since the beginning.
Her father was a diplomat.
I am thinking that the judge got a call from somebody in ICE that said “Yeah, if you let her back in, POTUS would like nothing better than a nice high profile TREASON trial right after we arrest her for it when she sets foot in US soil. It’s gonna be great to hear the Islamic Squad members and the dens defend this ignorant b-—!”.
Out of sight and off you tube & twitter.
It is possible to be born in the US and not a citizen. In this case, the passport is issued by mistake.
She renounced her citizenship and pledged loyalty to the Caliphate. Not a citizen count 1. Also was born to a foreign diplomate in the US, but is expressly not a real citizen, hence the need to have a passport issued. Not a citizen count 2.
She obtained the visa fraudulently.

A US citizen is one “subject to the jurisdiction of the United States”, which children of foreign diplomats are not.
Keep reading and you’ll find all kinds of “reasons” why she’s not a citizen...If one doesn’t work, then go to the other.
Because she was a child of a diplomat - because the Constitution said so - because she was given a US Passport by mistake - because she renounced her US citizenship in favor of a foreign power and it keeps going - take your pick! A lot of people speaking with authority here but who is right?

She was the daughter of a foreign diplomat ...
She was the child of embassy staff and she obtained the passport by crooked means.
I suppose you claim that a pregnant Mexican woman can steal across the border, pop out a baby, and the baby is an American citizen.
The passport was issued in error. She was still under her fathers diplomatic tenure when she was born. Plus, had she naturalized and became a citizen, she would have taken an oath, etc
