Man accused in terroristic threat inside a Springfield Walmart pleads guilty to amended charge

SPRINGFIELD, Mo. -- A Battlefield, Mo. man charged with making a terroristic threat at a south Springfield Walmart in August pleaded guilty to an amended charge.

Dmitriy Andreychenko, 20, pleaded guilty in a Greene County courtroom Friday to an amended charge of making a false report...

"I am glad that the courts worked with me, that they had grace on me, everything worked out great," Andreychenko said after Friday's hearing. "I would just like to apologize to the community. I would never hurt anyone, and I'm sorry."

A judge sentenced him to a 180 day suspended jail sentence, two years of probation, with special conditions requiring him to serve 48 hours shock incarceration in the county jail (which he already did in August), receive firearms training, and participate in a victim-offender dialog, a restorative justice measure, and any community service established through the restorative justice proceeding.

Police arrested Andreychenko on August 8 after walking into a Springfield Walmart Neighborhood Market, openly carrying a tactical rifle and at least 100 rounds of ammunition. Another man held him at gunpoint until officers arrived.

Andreychenko called it a social experiment, and he wanted to see if Walmart would honor his right to open carry. He told KY3 News he saw his decision was poor timing, given two mass shootings in recent days, but otherwise does not regret what he did.

Sooooooooo what was the "false report"?

My first reaction:

"Oh, he didn't do that either, but the State had to get him for something because we can't have people lawfully carrying arms that scare people who ought to know better, so they pinned this bullschiff on him? There's justice for you, sure, uh huh..."

And the law loses a little more respect. The damage is self-inflicted.

First, I think that what and when the stunt was pulled by the defendant was a very poor choice. Legal, but stupid.

I think that the gov had to change him with something just to tie up some loose ends. The plea probably eliminates any false arrest litigation which would make the state look bad.
Secondly, it elimates any charges that could possibly be filed agianst the fire fighter who detained the defendant at gun point. It wouldn’t look good for the helper ‘hero’ to be charged with a felony. Third, it lets all the snowflakes and anti-gunners record the incident as a ‘gun crime’ to bolster the numbers.

43.405. False reports, penalty. — A person who knowingly makes a false report of a missing person, or knowingly makes a false statement in any such report, to a law enforcement agency is guilty of a class A misdemeanor. 574.120. Making a terrorist threat, second degree — penalty. — 1. A person commits the offense of making a terrorist threat in the second degree if he or she recklessly disregards the risk of causing the evacuation, quarantine or closure of any portion of a building, inhabitable structure, place of assembly or facility of transportation and knowingly: (1) Communicates an express or implied threat to cause an incident or condition involving danger to life; or (2) Communicates a false report of an incident or condition involving danger to life; or (3) Causes a false belief or fear that an incident has occurred or that a condition exists involving danger to life. 2. The offense of making a terrorist threat in the second degree is a class E felony. 3. No offense is committed under this section by a person acting in good faith with the purpose to prevent harm. So a Class A Misdemeanor from a Class E felony.... No jail time ( already served) probation for two years, usually terminated after 1/2 the term if successful, etc. IOWs, he didn't do anything wrong..... But don't do it! The defense attorney is a well known 2A type who has a great reputation for winning. He was a prosecutor for decades and now is a defense attorney, again, for decades. Some are going to say thus is a win for the anti-gunners, but I beg to differ. He carried the bad ugly loaded AR15, duty kit, and 100+ rounds of horrible ammo, plus a (gasp) Handgun (loaded too) and several loaded mags of pistol ammo.... But is not held at court for anything related to arms or ammunition.... He now gets his weapons back under MO law.... 571.095. Confiscation of firearms and ammunition, when — exceptions. — Upon conviction for or attempting to commit a felony in violation of any law perpetrated in whole or in part by the use of a firearm, the court may, in addition to the penalty provided by law for such offense, order the confiscation and disposal or sale or trade to a licensed firearms dealer of firearms and ammunition used in the commission of the crime or found in the possession or under the immediate control of the defendant at the time of his or her arrest.

There is a thing called “discretion”. Simply because you can legally carry a firearm does not mean you should. To much “exhibitionism” on display. “SEE ME!”

I’ve often carried concealed in many dangerous locations where it was not at the time “legal” Never tried to “flash” it anywhere.

There are some things that are now legal you just don’t do.

I understand your line of reasoning but I say it’s emotionally based which is exactly the way the anti 2nd amendment crowd portrays the argument and wins the day.

I say your line of thought helps “win the day” especially with those who are otherwise liberty minded like I believe you probably are.

This is a good discussion. I’m not trying to goad you or troll you.

Question for you.
Do we lose liberty in major battles or by a thousand cuts?

If what he did was by the letter of the law legal (I live in Missouri and it was) and what the concerned citizen did was illegal (which it was) why do we make an exception due to emotion?
