SPRINGFIELD, Mo. -- A Battlefield, Mo. man charged with making a terroristic threat at a south Springfield Walmart in August pleaded guilty to an amended charge.
Dmitriy Andreychenko, 20, pleaded guilty in a Greene County courtroom Friday to an amended charge of making a false report...
"I am glad that the courts worked with me, that they had grace on me, everything worked out great," Andreychenko said after Friday's hearing. "I would just like to apologize to the community. I would never hurt anyone, and I'm sorry."
A judge sentenced him to a 180 day suspended jail sentence, two years of probation, with special conditions requiring him to serve 48 hours shock incarceration in the county jail (which he already did in August), receive firearms training, and participate in a victim-offender dialog, a restorative justice measure, and any community service established through the restorative justice proceeding.
Police arrested Andreychenko on August 8 after walking into a Springfield Walmart Neighborhood Market, openly carrying a tactical rifle and at least 100 rounds of ammunition. Another man held him at gunpoint until officers arrived.
Andreychenko called it a social experiment, and he wanted to see if Walmart would honor his right to open carry. He told KY3 News he saw his decision was poor timing, given two mass shootings in recent days, but otherwise does not regret what he did.

I was wondering how the Dmitriy Andreychenko matter would be handled.
My first reaction:
"Oh, he didn't do that either, but the State had to get him for something because we can't have people lawfully carrying arms that scare people who ought to know better, so they pinned this bullschiff on him? There's justice for you, sure, uh huh..."
And the law loses a little more respect. The damage is self-inflicted.
First, I think that what and when the stunt was pulled by the defendant was a very poor choice. Legal, but stupid.
I think that the gov had to change him with something just to tie up some loose ends. The plea probably eliminates any false arrest litigation which would make the state look bad.
Secondly, it elimates any charges that could possibly be filed agianst the fire fighter who detained the defendant at gun point. It wouldn’t look good for the helper ‘hero’ to be charged with a felony. Third, it lets all the snowflakes and anti-gunners record the incident as a ‘gun crime’ to bolster the numbers.
I was there that day.. it was over, with him in the gas station grass by the time i got there. MO is Constitutional carry.... I miss that already.

Conservatives should never employ pragmatism and then wonder why we lose liberties.
There is a thing called “discretion”. Simply because you can legally carry a firearm does not mean you should. To much “exhibitionism” on display. “SEE ME!”
I’ve often carried concealed in many dangerous locations where it was not at the time “legal” Never tried to “flash” it anywhere.
There are some things that are now legal you just don’t do.
Your second paragraph sums up the problem very neatly. NO crime, NO charge (EXCEPT the false arrest)!!
As for the other citizen, the fact he didn’t fire saves him. An apology for having done it is in order, as is the calm acceptance of said apology.

And trying to make a political point in a Wal-Mart two days after a mass shooting in a Wal-Mart is stupid. He’s not a bad guy but he has helped those who oppose 2nd Amendment Rights.
I understand your line of reasoning but I say its emotionally based which is exactly the way the anti 2nd amendment crowd portrays the argument and wins the day.
I say your line of thought helps win the day especially with those who are otherwise liberty minded like I believe you probably are.

If what he did was by the letter of the law legal (I live in Missouri and it was) and what the concerned citizen did was illegal (which it was) why do we make an exception due to emotion?
