This Impeachment Subverts the Constitution
Wall Street Journal via MSN ^ | Oct. 26, 2019 | David B. Rivkin, Jr. @ Elizabeth Price Foley

Speaker Nancy Pelosi has directed committees investigating President Trump to “proceed under that umbrella of impeachment inquiry,” but the House has never authorized such an inquiry. Democrats have been seeking to impeach Mr. Trump since the party took control of the House, though it isn’t clear for what offense. Lawmakers and commentators have suggested various possibilities, but none amount to an impeachable offense. The effort is akin to a constitutionally proscribed bill of attainder—a legislative effort to punish a disfavored person. The Senate should treat it accordingly.

“Presidents often delay or refuse foreign aid as diplomatic leverage, even when Congress has authorized the funds. Disbursing foreign aid—and withholding it—has historically been one of the president’s most potent foreign-policy tools, and Congress cannot impair it.”

This is what I’ve been saying.

What Pelosi is doing is immoral, unprecedented and simply wrong and unfair to Trump.

But I’m still not convinced that there is anything in the law, the Constitution or the House rules that would prevent her from conducting her secret investigation.

If this was an illegal action I would expect a lawsuit from Trump.

OTOH, I still have hopes that Trump will eat away at whatever thin vote margin Pelosi has as the polls come in showing these idiot Democrats how stupid they are, particularly in light of the zero evidence of an impeachable crime.

This weekends events are not working in Pelosi’s favor or, in fact, for the many Republicans and Generals who are still wiping the egg of their face as I type this.

All this is about a “leak-fest” where the Dems can leak fake news to the press. The shoe is about to drop on them and this is an attempt to deflect it. Not gonna work, guys...

"The House of Representatives...shall have the sole Power of Impeachment."

Why vote now? I thought the Scheming and Deeming Nancy Pelosi can just deem that the impeachment inquiry already started - just like "deeming" that ObamaCare was good-to-go out of the House. Why the change?

You are right. The Constitution, clearly, looks to a celebration of individual achievement; thus the prohibition on taxation for the purposes of social engineering. Thus the purpose statement in the Preamble. Thus the phenomenal individual achievement in the era when the limitations on Federal power were considered sacred.

Mrs. Pelosi is all about a Socialistic war on the high achieving individual--a total abandonment of the aspirational heritage of the American people.

Impeachment IS a Bill of Attainder, but it is specifically provided for in the Constitution as an exception to the general rule against such.

These are not impeachment proceedings and nowhere does it say that the House can go fishing/looking for a crime to start any kind of impeachment.

This is just my opinion but ...
The Constitution recognized that certain universal rights cannot be taken away by legislation, (Or Pelosi).

Some laws, under the constitution are inalienable and one of them is Due process which includes being served with notice, and having the right to be heard and defend himself or herself.

In other words: The Right to face any witnesses for the prosecution.

As I said, this is only my opinion.

The Senate should vote not to hear the impeachment on its merits and to send it back to the House — because it fails to make a credible allegation of treason, bribery, or any other impeachable offense. Kinda like a judge dismissing a criminal case for failure to allege a crime.

They just realized that this was Hillary’s plan for Nixon...which was called unconstitutional as it denied Nixon right to counsel during the inquiry.

since the party took control of the House, though it isn’t clear for what offense.

The offense was winning the election.

...a lawsuit ...

There is no Constitutionally mandated judicial remedy for a political food fight, even when the meatballs contain razor blades. Pelosi quoted the court (or the pertinent legal authority) out of context, making it sound like the House majority exists as an equal to the Executive branch. In fact, the House majority only has sway within the House.

Along with the smoke and mirrors, expect the breaking of much sugar glass and additional CGI FX.

Every successful story has a subplot. I fully believe Trump has already written & produced one. The various letters, TV quotes and campaign utterances by the progs will provide ironic contrast.

This is a story. Maybe, back in the Golden Age of literature or even of movies, a skilled author/screenwriter could manage to braid these elements into a blockbuster. Today, however, few of these artists exist and from what I have seen as a consumer of stories, none of them exist on the prog side. They are only capable of presenting a shallow A roll, a thin plot with no resonance or contrast.

OTOH, the audience is uneducated and some may be convinced this is a successful approach.

Mitch sent a letter signed by 50 republicans that essentially said she needed to take the vote, or else the senate wouldn't cooperate with the House's impeachment process.
